ORDINANCE NO. ‘7
AN ORDINANCE Fixing, Imposing, and Levying a
Reasonable Garbage Collection Fee Upon Every
Owner, Lessee, Permittee , or Agent in Charge
of Any Property, Serviced by the Garbage Col-
lection Force of the Town of Atlantic Beach,
Duval County, Florida; and Prescribing Civil
Remedies for the Delinquency of Any Such Fee.
BE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL OF
THE TOWN OF ATLANTIC BEACH , DUVAL COUNTY, FLORIDA:
Section 1 : There is herein and hereby fixed,
imposed and levied, in the manner, according to the
schedule and definitions , and under the circumstances
subsequently set forth, and upon every owner, lessee ,
permittee , or agent in charge of any real property ser-
viced by the garbage collection force of the Town of
Atlantic Beach, Duval County, Florida, a reasonable fee
for such service .
A) For the purposes and within the purview
of this Ordinance the following definitions shall prevail :
1. " Private Living Unit" . A "private
living unit" is a residence occupied by and the place of
abode of a single family, where one kitchen only is pro-
vided and maintained.
2. "Commercial 'A' Unit" . A " commercial
At unit" is any business establishment, store, house ,
or shop, where foodstuffs and sustenances of any kind are
substantially handled, kept, bought, or sold. Within
this classification are , by way of example only, fish,
poultry, and meat markets; bakeries , package houses and
bars; grocery and drug stores ; cold drink and hot dog
stands ; and the like. Hotels, and apartment and rooming
houses of more than 10 rooms each, fall within the
classification of "commercial 'A' units" .
3. " Commercial 'B+ Unit" . A " commercial
B, unit" is any business establishment, store , house or
shop where foodstuffs and sustenances are handled or found
either only incidentally and infrequently, or not at all.
Within this classification are , by way of example only,

drygoods and notions, beach toggery, clothing, hardware,
and 5 and 10 cent stores ; jewelry, antique and novelty,
and souvenir shops ; ice houses; and service and filling
stations and garages. Hotels, and apartment and rooming
houses of 10 rooms or less, fall within the classification
of "coirunercial !Et units" .
B) The fee for the collection of garbage
from a private living unit is hereby fixed and levied

at the sum of iE54 annually; such fee for such collec-
tion from a commercial "A" unit is hereby fixed and levied
at the sum of 35. 00 annually; and such fee for such col-

lection from a commercial "B" unit is hereby fixed and
levied at the sum of 6:125.00 annually.
C ) Every such garbage collection fee shall
be computed initially for the calendar year beginning
January 1, 15Y1 , and shall be payable for each and every
II n) ' several year thereafter. Payments may, at the option of
the particular owner, lessee, permittee , or agent re-
sponsible therefor, be made either (1 ) in a lump sum
entirety, annually in advance , commencing on January 1,
19)111 , ( in which event a discount of /G % of the amount
of the annual fee shall be allowed) , or (2) in equal in-
stallments, every 4 months ; commencing on January 1,
1944, and continuing on each May 1st , September 1st, and
January 1st thereafter.
Section 2: Garbage collection fee obligations
intended to be retired under the first method permitted
by Section 1 ( C ) , next above , become delinquent if not
paid by January 11th of each calendar year; and such
obligations intended to be retired under the second method
permitted by said Section 1 ( C ) become delinquent if any
installment thereof is not paid by the 11th day of the
month in which such installment may respectively fall due .
The said Town of Atlantic Beach may discontinue its gar-
bage collection service to any property or unit, the owner,
lessee, permittee , or agent in charge of which has allowed
any fee imposed hereunder to become delinquent; and the
said Town may recover the amount of any such delinquent
fee by due process of law.
