AN ORDINANCE Regulating the Keeping of Dogs in the
Town of Atlantic Beach, Duval County, Florida;
Authorizing the Impounding of Stray Dogs and the Sale
or Destruction of Unredeemed Impounded Dogs or Any
Vicious Dogs Found In or Upon the Public Streets or
Places in said Town in Violation of This Ordinance ;
and Providing a Penalty for the Punishment of Persons
Unlawfully Permitting Any Dog to Go at Large In or Upon
the Public Streets or Places In said Town.
BE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL OF THE
TOWN OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA:
SECTION 1. Any person owning or harboring any dog or
dogs upon any premises within the Town of Atlantic Beach, Duval
County, Florida, shall keep the same securely within the kennel,
yard or premises of such person; and it shall be unlawful for
any person, without complying with this Ordinance , to suffer or
permit any dog in the custoay of or belonging to such person to
run at large upon any public street or place, or upon the beach,
within the corporate limits of said Town.
SECTION 2. The owner or person in possession of any
dog may register the same with the Town I, arshal and receive a
permit to allow said dog to go upon the public streets or places ,
or upon the beach, if said dog is securely muzzled. An inspection
fee of 41 .00, to cover the cost of such inspection and the furnish-
ing of a small metal tag for the identification of such dog, is
registered; which inspection fee shall be paid into the general
fund of said Town--and the Town Marshal shall file a monthly
report with the Town Clerk of all collections, and of all his
acts in the administration of this Ordinance . This Ordinance
shall not apply to a dog held on a leash in the custody of a
person competent to manage such dog.
SECTION 3 . It shall be the duty of the Town Marshal to
take up and impound every dog found running at large in violation
of this Ordinance, and give notice immediately to the owner, if
known; and if unknown, to post a notice at the door of the Tov:n
Hall, describing such dog, and announcing said Marshal ' s intention
of destroying said dog after three days from the date of the giving
or posting of said notice , unless said dog be redeemed. Provided,
however , that if the said dog shall have any value, the Town
arshal may give notice that it will be sold instead of destroyed--
in which event said dog may, within ten days after the giving or
posting of said notice , be sold by the Town marshal at public or
private sale, and for any sum which to him shall seem reasonable ;
and the monies derived from such sale shall, immediately there-
after, be paid into the general fund of said Town. A redemption
fee of 41.00, together with 10 cents for each day that such dog
has been fed, shall be collected aria imposed as part of the costs
in the event of either impounding, or impounding and sale . The
Town Marshal may employ a special Deputy to suppress and impound
stray dogs running at large in violation of this Ordinance , and
may allow to such Deputy, out of the pound fees and charges,
50 cents for each dog which said Deputy impounds.
SECTION 4. Unredeemed dogs, or dogs which are vicious
to an extent endangering the public , and running at large in
violation of this Ordinance, may be shot, or captured and
destroyed.
SECTION 5 . any person interfering with the performance
of the Town Y, arshal or any Deputy thereof in the enforcement of
this Ordinance , or whosoever shall willfully suffer or permit
any dog to run at large in violation of this Crdinance, or shall
otherwise violate the same , shall be punished by a fine not
exceeding 0..0 .00, and in default of the payment of such fine, by
imprisonment for a period not exceeding 5 days.
