AN ORDINANCE Providing for the Declaration and Abatement
as Nuisances of Certain (A) Defective Septic Tanks and
B) Containers in the Town of Atlantic Beach, Duval County,
Florida; and Imposing in This Behalf Certain Penalties.
BE IT ORDAINED BY THE MAYOR AND THE TON COUNCIL OF
THE TOWN OF ATLANTIC BEACH, DUVAL COUNTY, FLCIDA:
Section 1: When the Town Council of the Town of
Atlantic Beach, Duval County, Florida , acting in the reasonable
exercise of its discretion, determines that (A) any inadequate,
leaking, overflowing, defectively constructed or improperly
maintained septic tank, or (B) any box, can, bucket, container,
or other receptacle partly or wholly filLed with stagnant water
or other noxious liquid or substance in the said Town, is
dangerous or detrimental to its citizens , or involves an undue
risk to the health, morals , convenience , and safety of such
citizens, then the said Town Council may declare such septic
tank, or such container or receptacle to be a nuisance; and
thence forth adopt in connection therewith, either of the
following courses:
It may direct the Town Clerk of the said Town to
notify and direct in writing the owner, occupant, or agent of
any premises in or upon which said nuisance is situated, to
abate the same within ten (10) days of the date of said written
notification. If such owner, occupant, or agent refuses so to
do, (a) he may be fined not more than Twenty-Five Dollars ($25) ,
or imprisoned, or both, for each several days contumacy of the
said Town Clerk's said notification; or (b) the said Town Council
may direct the City Supervisor and the Town Marshal of the
said Town to employ all necessary means and properly repair
or rebuild the said septic tank, or empty, disinfect,
destroy, remove or confiscate any of the aforesaid containers
or receptacles--charging to and collecting from said owner,
occupant, or agent, in an action at law brought by the said
Town of Atlantic Beach, if need be, all damages , costs and
expenses respectively sustained , incurred and suffered by
such abatement.
