087 vORDINANCE NO. 7 AN ORRDINANCE Providing for the Connecting of Sewage Disposal Facilities in Private Premises with the han Hole and Facilities of the Town of Atlantic Beach Connecting with the Sewage System of the Town of Neptune Beach, Florida; Authorizing the Laying of Pipe Lines and Equipment in and across the Streets of said Town for Such Purpose; Providing the Conditions under which said Connections and said Use of said Streets shall be made ; and fixing and establishing Fees and Charges to be paid for the rivilege of Connecting with and using said Facilities of said Town. BE IT ORDAINED BY THE MAYOR AND THE TOWN COUIICIL OF THE TOWN OF ATLANTIC BEACH, DUVAL COUNTY, $I,ORIDA: Section 1: Any person or corporation desiring to connect sewage disposal facilities or plumbing in premises owned by such person or corporation with the man hole and disposal facilities of the Town of Atlantic Beach, connecting with the sewage disposal system of the Town of Neptune Beach, Florida, by agreement between said Towns, shall make applica- tion to the Town Supervisor for a permit so to do, stating therein the proposed location of all pipes, pipe lines and equipment to be laid or installed for such purpose, the character and style of the materials and equipment to be used and the proposed manner of doing the work. All such connecting lines shall be constructed of such mater:als and equipment and in such manner as to comply with and conform to the specifica- tions and requirements of the state Board of Health of Florida. All pipe lines, e,uipment and facilities constructed between the owner' s premises and the facilities of said Town in order to make such connections, shall in all cases be the property of the owner of such premises and shall be constructed, main- tained and kept in repair by and at the expense of such owner. All work, whether original construction, maintenance or repair, shall at all times be done under and subject to the supervision and direction of the Town Supervisor. Section 2: The right ani. authority is hereby given to everyone having first secured a permit to make such connection with said facilities of said Town to lay such pipes and equipment as may be necessary or proper and to ma_:e such excavations and to remove such pavements, temporarily, as may be necessary in and across any streets of said Town; provided, however, that the same shall be laid or placed only at such loc- tions in or across such streets, at such depth below grade, and otherwise as may be designated and directed by the Town Supervisor; and provided further that anyone so laying the same in or across any street shall place every such street in as good condition as it was prior to any excavations therein or the removal of any pavement thereon with as much speed as is practicable under the circumstances. Section 3: The following fees and service charges are hereby fixed and established and shall be paid for the privilege of connecting with and using the said facilities of said Town: D a) A connection or tap fee of 4 30 for each separate business or housing accommodation unit so connected with such facilities, to be paid upon the granting of the permit for the making of such connection; b) An annual service charge for each said unit of N-o-i n l d o o eact amount to be set from time to time by Resolution of payable lia—clwarterly Lia04,911 in advance on ( Counc the first day of—J=.. - . : r--= r in each year; 4kb provided, that where any unit is connected with such facilities for less than a full g „- 4 rd' period, the • for such period shall be reduced proportionately. Should any service charge not be paid within ten (10 ) days after same becomes due and payable, the same shall bear interest at the rate of ten per cent (10/0) per annum until paid; and the Town Council may by resolution direct the Town Supervisor to disconnect or cause to be disconnected from the said facilities of said Town any line or connection thereto for which the charge aforesaid shall not have been paid within the time as herein required. The of the premises involved disconnecting of any such line shall nct relieve the owner/ or any occupant thereof from the duty to comply with the require- ment of any Ordinance of the Town, including Ordinance Lo. 71 requiring that premises be provided with approved excreta disposal facilities and that the same be maintained. I Section 4 : Every application to connect sewage disposal facilities and ulumbing in private premises with the said facilities of said Town meeting all of the require- ments of this Ordinance shall be granted by the Town Supervisor unless he finds and determines that to grant the same would over-burden said facilities of said Town.
