116 vORDINANCE NO. //(j iv7°-S-7-AN ORDINANCE TO AMEND AN ORDINANCE ENTITLED "AN ORDINANCE 3 Providing for the Zoning of the Town of Atlantic Beach, Duval County,Florida, Under and Pursuant to Chapter 196$$ of the Laws of Florida, Special Acts of 1939, entitled "An Act Authorizing the Town of Atlantic Beach, Florida, to Provide For, and Prescribe Zoning Regulations ; and Repealing Chapter 16313, Laws of Florida, Special Acts of 1933, entitled An Act to Provide and Authorize the Town of Atlantic Beach, Duval County,Florida, to Provide and Prescribe Zoning Regulations, " BE IT ORDAINED BY THE MATOR AND TOWN COUNCIL OF THE TOWN OF ATLANTIC BEACH, FLORIDA That Section 1. An ordinance entitled "AN ORDINANCE Providing for theZoningoftheTownofAtlanticBeach, Duval County, Florida, Under and Pursuant to Chapter 196$$ of the Laws of Florida, Special Acts of 1939, entitled "An Act Authorizing the Town of Atlantic Beach, Duval County,Florida, to Provide and Prescribe Zoning Regulations" " be and the same is hereby amended by striking therefrom paragraph 17 of ARTICLE II and substituting therefor the following words and figures, to wit: 17) Enclosed: Not open, but shut in by solid walls. Glass shall be considered a part of such solid walls. Lattice work, screening, or garage doors shall not be considered "Enclosed". Section II. Be it further ordained that paragraph (S) of ARTICLE III of the said Ordinance be and the same is hereby striken therefrom and the following words and figures be substituted therefor: S) Minimum Coverage. In any residence district the main dwelling shall have, as a minimum, the following enclosed coverage : 1. 750 square feet for a one story dwelling. 1-A. 700 square feet, for a one story dwelling in Residence A-1 District and in that portion of the Saltair sub- division Zoned as Residence B District lying west of Sylvan Drive and that portion of Saltair Boulevard running northeasterly from its intersection with Sylvan Drive. 2. 600 square feet for a one and one-half, two or three story dwelling, notwithstanding the provisions of sub-paragraph 3) below. 3. In cases of more than one living unit per dwelling, each living unit shall have, as a minimum, 500 square feet enclosed coverage. This provision shall not apply to apartment houses or hotels that are subject to the Laws of the State of Florida requiring approval of plans and specifications by the State Hotel Commission. Section III. Be it further ordained that Article I of said Ordinance shall be , and is hereby amended by adding immediately follow- ing paragraph (1) another paragraph as follows: 1-A) . Residence A-1 District and by changing the Zoning Map to show this District within the following described boundaries to wit : All that portion of Saltair Sub-division now shown on the Zoning Map as Residence A lying west of Sylvan Drive. Section IV. Be it further ordained that the said ordinance be, and the same is, hereby amended by adding immediately following Article IV - Residence A District the following words and figures to wit : ARTICLE IV-A Residence A-1 District A) Uses : Within any Residence A-1 District, as indicated on the Zoning Map, no building or premises shall be used and no building or structure shall be erected which is intended or designed to be used in whole or in part for any industry, trade, manufacture, or :,ommercial purposes or for other than one or more of thefollowing specified purposes. 2 1. Any use specified above in Article IV (A) and permitted in Residence A District. Section V. Be it further ordained that Article V, Residence B District of the said ordinance be, and the same is hereby, amended by adding following sub-paragraph (2 , the following words and figures to wit : 3) Any use specified above in Article IV-A (A) and permitted in Residence A-I Districts; provided, however, that such uses # r applies only to the area shown on the Zoning Map as Residence B District lying west of Sylvan Drive and west of that portion of Saltair Boulevard where it intersects and joins Sylvan Drive and continues in a north easterly direction, all within the Saltair Sub-division. Section VI. Be it further Ordained that this Ordinance shall not be construed as changing or affecting that part of Ordinance Number 99 in so far as it relates to Residence D District. Section VII. Be it further Ordained that this Ordinance take effect upon its approval by the Mayor.
