AN ORDINANCE TO AMEND AN ORDINANCE ENTITLED:
AN ORDINANCE fixing, Imposing, and Levying a
Reasonable Garbage Collection Fee Upon Every
Owner, Lessee , Permittee, or Agent in Charge
of Any Property, Serviced by the Garbage Col-
lection Force of the Town of Atlantic Beach,
Duval County, Florida ; and Prescribing Civil
Remedies for the Delinquency of Any Such Fee.
BE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL OF THE
TOWN OF ATLANTIC B EACH, DUVAL COUNTY, FLORIDA :
1. That sub-paragraph C of Section 1 of an Ordinance
entitled "AN ORDINANCE fixing, Imposing, and Levying a
reasonable garbage collection fee Upon Every Owner , Lessee ,
Permittee , or Agent in Charge of Any Property, Serviced by
the Garbage Collection Force of the T own of Atlantic Beach,
Duval County, Florida; and Prescribing Civil Remedies for
the Delinquency of Any Such Fee," be and the same is hereby
amended so as to read as follows:
C) That beginning January 1, 1949 such garbage col-
lection fee shall be computed for the six months period be-
ginning January 1, 1949 and ending June 30, 1949 and a dis-
count of 10% shall be allowed if payment for this period is
made on or before February 1, 1949. Beginning July 1, 1949,
every such garbage collection fee shall be computed for the
twelve months period beginning July 1 , 1949 and shall be pay-
able for each and every twelve months period thereafter. Pay-
ments may at the option of the particular owner , lessee , permit-
tee or Agent responsible therefor be made either (1) in a lump
sum entirety for the twelve months period commencing on July 1 ,
1949 ( in which event a discount of ten percent of the amount of
the yearly fee shall be allowed) or (2) in equal installments
every four months commencing on July 1, 1949 an d continuing on
each November 1st , March 1st and July 1st thereafter, or in
equal Monthly installments payable on the first day of each
month beginning July 1, 1949.
2. That Section 2 of said Ordinance entitled as
aforesaid be and the same is hereby amended to read as follows:
Garbage collection fee obligations intended to be
retired on a twelve months or yearly basis as permitted in
the preceding section hereof, become delinquent if not paid by
July 11th of each year; and such obligations intended to be
retired on a monthly or quarterly installment basis as permitted
by said preceding section become delinquent if any installment
thereof is not paid by the 11th day of the month in which such
installment may respectively fall due. The said Town of Atlantic
Beach may discontinue its garbage collection service to any
property or unit , the owner, lessee , permittee of agent in charge
of which has allowed any fee imposed hereunder to become delin-
quent ; and the said Town may recover the amount of any such
delinquent fee by due process of law.
3. This Ordinance shall take effect on its passage and
approval by the Mayor.
