130-A vt • J3o- 741 ORDINANCE calling and providing for a special election in the Town of Atlantic Beach, Florida, in connection with the issuance of bonds of said Town for water system purposes. ti WHEREAS it has heretofore been determined to be necessary that the Town of Atlantic Beach, a municipal corporation organized Vii'and operating under the provisions of Chapter 13907, Laws of Florida 1929, as amended and supplemented, and located in Duval County, Florida, establish and construct a municipal water system and that for the purpose of paying the cost thereof it will be necessary for said town to issue bonds to the amount of One Hundred. Fifty Thousan. Dollars ($150,000) ; and WHEREAS it is permitted and provided by Section 4 of House Bill No. 237 of the Acts of the Legislature of Florida, 1949, that said town may issue and sell its bonds for such municipal purposes as may be provided by ordinance and for the payment of which, including interest thereon, the entire taxable property in said town may be pledged and in addition the revenue of the partic lar utility or facility to be constructed may be Pledged; provided, such ordinance is approved by a majority vote in an election in which a majority of the freeholders who are also qualified electors as defined in said House Bill No. 237, shall participate; and WHEREAS it is also required by Section 6 of Article 9 of the Florida Constitution as amended that the issuance of such bonds, by said town be approved by a majority vote in an election in which a majority of the freeholders who are qualified electors, as defined by Section 1 of Article 6, shall have participated; and. WHEREAS by an ordinance concurrently adopted and entitled1, An Ordinance authorizing and providing for the issuance of $150,000 Water System Bonds of the Town of Atlantic Beach, Florida, and for the payment of same as to both principal and interest from the levy of taxes, and in addition, the net income and revenue from the operation of the municipal water system of said town," it is I 4 provided, that subject to (1) the approval of said ordinance by a majority of the freeholders who are qualified electors as defined in said House Bill No. 237, and (2) approval of the proposition of issuing bonds by a majority vote of the freeholders who are quali- fied electors in said town as defined by Section 1 of Article 6 of the Florida Constitution, said bonds shall be issued for the pur- iiikk pose aforesaid, and it is deemed advisable that a special election be called and held in and for said town for the purpose of sub- mitting and voting upon the approval of said ordinance and upon the proposition of issuing said bonds by the respective qualified electors as aforesaid; NOW, THEREFORE, Be It Ordained by the Mayor and Town Council of the Town of Atlantic Beach, Florida, as follows : Section 1. That a special election is hereby called and ordered to be held in and for the Town of Atlantic Beach, Florida, on November 15_, 1949, from seven o'clock A.M. until seven o ' clock P.M. , at which the ordinance entitled, "An Ordinance authorizing and providing for the issuance of 4150,000 Water System Bonds of the Town of Atlantic Beach, Florida, and for the payment of same as to both principal and interest from the levy of taxes, and in addition, the net income and revenue from the operation of the muni- cipal water system of said town," shall be submitted for approval by the freeholders who are qualified electors in said town as defined in House Bill No. 237 of the Acts of the Legislature of Florida, 1949, and there shall also be submitted to the freeholders who are qualified electors in said town as defined by Section 1 of Article 6 of the Florida. Constitution the proposition of said town issuing bonds to the amount of 4150,000, bearing interest at the rate of four per cent (4%) per annum for the purpose of establish- ing and constructing a municipal water system. For municipal elec- tions generally in said town all of said town constitutes a single 2- J election precinct, and the polling place for such elections is usually at Town Hgli in said town, and accordingly for the special election aforesaid all of said town shall constitute a single election precinct, and the polling place for same shall be at said Town Hall in said town. Section 2. Only those freeholders who are qualified electors as aforesaid and who have duly registered according to law shall be qualified to vote at said special election on the respec- tive propositions. The Town Clerk as Supervisor of Registration shall close the registration books of said town for voting at said special election at five o 'clock P.M. on November 15, , 1949, which date is not less than five days before the date of said elec- tion, and said Town Clerk as Supervisor of Registration for said town is hereby authorized and directed to cause to be prepared a list of the names of all freeholders who are qualified electors as defined in said House Bill No. 237 and who are thereby qualified to vote on the approval of said ordinance, and a list of the names of all qualified electors who are determined to be freeholders in said town as defined by Section 1 of Article 6 of the Florida Constitu- tion and who are thus qualified to vote at said election on the proposition of issuing bonds, as aforesaid; and to furnish a certi- fied copy of each such list to the inspectors and clerk of the election. There being no official basis for compiling the list of freeholders who are qualified electors, as defined in said House Bill No . 237, only those :persons so qualified who appear and regist r for said election pursuant to the notice hereinafter prescribed shall be entitled to vote on the proposition of the approval of sai ordinance. Said Town Clerk as Supervisor of Registration shall prepare the list of freeholders who are qualified electors as de- fined by Section 1 of Article 6 of the Florida Constitution by referring to the records of the Supervisor of Registration for Duval County. 3 3 Any qualified elector in the State of Florida who has resided in said Town of Atlantic Beach thirty (30) days during the calendar year 1949, and who shall register as provided by this ordinance, and who is a freeholder in said town, shall be a qualified elector as defined in said House Bill No. 237, and shall be entitled to vote on the approval of said ordinance. Every person who is a qualified elector for elections generally in said Town of Atlantic Beach and who is also a freeholder and has his habitation, domicile, home and place of permanent abode in said town, shall be qualified to vote at said election on the proposition of issuing bonds as aforesaid. It will thus appear that any person qualified to vote at said election on the proposition of issuing bonds will be quali- fied also to vote on the approval of said ordinance, and will conse- quently at the time of voting be supplied with a ballot for each of the propositions, but where the person does not have the qualifica- tions for voting on the proposition of issuing bonds as aforesaid, but only the qualifications for voting on the approval of said ordinance, a ballot for voting only on the approval of such ordin- ance shall be supplied at the time of voting. Section 2. For Bonds Against Bonds 5- J Section 5 . That for said election the following named persons shall act as Inspectors and Clerk: II Inspectors Clerk 1. 2. Mrs. Harcourt Bull, Jr. Robt. E . Carmody Upon the closing of the polls for said special election said inspectors and clerk shall file a report of the results thereof with the Town Clerk in order that such results may be thereafter canvassed and officially declared by this Mayor and Town Clerk. Section 6. That the Mayor and Town Clerk are hereby authorized and directed to give notice of said special election and of the propositions to be submitted thereL.t, and of the registration of qualified voters by publication thereof at least once each week for at least four consecutive weeks commencing not less than thirty days prior to said election, in the Ocean Beach Reporter , a news- Jacksonville paper published in the City of Beach, Duval County, Florida, and having general circulation throughout said Town of Atlantic Beach.. Said notice of election to be published as aforesaid shall be in substantially the following form: 6- iL J i4 NOTICE OF SPECIAL ELECTION Town of Atlantic Beach, Florida PUBLIC NOTICE is hereby given that pursuant to ordinance duly adopted by the Mayor and Town Council of the Town of Atlantic Beach, Florida, a special election has been called and ordered held in and for said town from seven o' clock A. M. until seven o ' clock P. M. on the 15th day of November , 1949, at which the following propositions will be submitted: Proposition of approval or rejection of an ordinance adopted October 10th , 1949, by the Mayor and Town Council of the Town of Atlantic Beach, Florida, entitled "An Ordinance authorizing and. providing for the issuance of 4150,000 Water System Bonds of the Town of Atlantic Beach, Florida, and for the payment of same as to both principal and interest from the levy of taxes, and in addition, the net income and revenue from the operation of the munici- pal water system of said town; and Proposition of the Town of Atlantic Beach, Florida, issuing bonds to the amount of $150,000, bearing interest at the rate of four per cent (4%) per annum, for the purpose of establishing and constructing a municipal water system in and for said. town. Said special election will be held at the same polling place whereat elections are generally held in said town, and the polling place will be at Town Hall in said town. All qualified electors in the State of Florida who have resided in said Town of Atlantic Beach thirty (30) days during the calendar year 1949 and who have registered with the Town Clerk as Supervisor of Registration, and who are freeholders in said town, shall be qualified to vote on the proposition of approval of the ordinance, as aforesaid; and all registered qualified electors for elections generally in said town and who are freeholders in said town and have their habitation, domicile, home and place of permanent abode in said town, shall be qualified to vote on the proposition of issuing bonds as aforesaid. The Town Clerk of said town, as Super- visor of Registration, will close the registration books on 7- November 10th , 1949, for the purpose of making up the lists of the names of those persons qualified to vote on the respective propositions.
