Forsyth 825 East Coast Drive Atlantic Beach, FL 32233 ZVAR23-0023 330 Sargo Road (RE#171684-0000) ORDER APPROVING ADMINISTRATIVE VARIANCE The above referenced applicant requested an administrative variance as permitted by Section 24-64, to allow a reduction of the rear yard setback by twelve (12) inches. Per the Residential, Single -Family (RS - 1) zoning district setbacks found in Section 24-105(e) the minimum rear yard shall back is twenty (20) feet. According to a letter dated August 31, 2023 furnished by the surveyor a scrivener error occurred on the original survey that that was used to construct the house. The house was setback the distance of the scrivener's error and therefore, encroached into the rear yard setback. Upon review of the application and previous building plans, the administrative variance of twelve (12) inches is approved based on Section 24-64 "Administrative variances may also be authorized where an inadvertent surveying error has resulted in placement of a building". The rear yard setback is reduced from the required 20 feet to 19 feet. Appeals of a decision of the Planning and Community Development Director may be made to the City Commission by any adversely affected person(s). Such appeal shall be filed in writing with the City Clerk within thirty (30) days after rendition of this Order. The appellant shall present to the City Clerk a petition duly verified, setting forth that the decision being appealed is in conflict with or in violation of Chapter 24, Zoning, Subdivision and Land Development Regulations for the City of Atlantic Beach, in whole or in part, and specifying the grounds of the conflict or violation.
