Per Section 24-151(b)(1)e, detached garages may be constructed to a height of twenty five (25) feet provided such structures comply with applicable side yard requirements.The side yard for this property is 7.5 feet.The requested administrative variance is to waive 0.1 feet of the 7.5 foot side yard setback. Upon review of the application and previous building plans, the administrative variance is approved due to exceptional circumstances preventing the reasonable use of the property as compared to other properties in the area. It appears the 7.4 feet measurement on the survey was measured to the siding of the detached garage and not to the foundation. Per policy regarding setbacks and their measurement, dated January 5, 2017 and signed by Nelson Van Liere, City Manager, setbacks are measured to the exterior structural wall and not to the exterior siding. Appeals of a decision of the Planning and Community Development Director may be made to the City Commission by any adversely affected person(s). Such appeal shall be filed in writing with the City Clerk within thirty(30)days after rendition of this Order.The appellant shall present to the City Clerk a petition duly verified,setting forth that the decision being appealed is in conflict with or in violation of Chapter 24, Zoning, Subdivision and Land Development Regulations for the City of Atlantic Beach, in whole or in part, and specifying the grounds of the conflict or violation.
