Dear Property Owner:
Please be advised, the City of Atlantic Beach Code of Ordinances includes rules and regulations
governing construction activities and also maintenance standards for property within the City. These
standards are set forth in the International Property Maintenance Code and the Florida Building Code
and were adopted as part of the City of Atlantic Beach Code of Ordinances in Chapter 6, Article II,
Section 6-16.
A code enforcement inspection at 1611 MAIN ST was conducted on 1/8/2024. The City of Atlantic
Beach Code Enforcement has found your property to be in violation of the City of Atlantic Beach Code
of Ordinances:
NATURE OF VIOLATION: We have received a complaint regarding someone living in the shed in
the backyard of the home. Upon review of the records, it was determined that no building permit was
ever requested for the shed, no permits were requested for the additions to the shed, and no inspections
were ever performed to confirm the shed was built in compliance with code.
APPLICABLE CODES:
FBC Section 105 Permit 105.1 Required. Any owner or authorized agent who intends to construct,
enlarge, alter, repair, remove, demolish, or change the occupancy of a building or structure, or to erect,
install, enlarge, alter, repair, remove, convert or replace any required impact resistant coverings,
electrical, gas, mechanical or plumbing system, the installation of which is regulated by this code, or to
cause any such work to be done, shall first make application to the Building Official and obtain the
required permit.
Chapter 24. Land Development Regulations. Sec. 24-151. - Accessory uses and structures. (b)
Accessory uses and structures by zoning district. (2) In any zoning district, except as to private
swimming pools, and unless specifically provided otherwise in this chapter. b. No accessory structure
shall be used as a residence, temporarily or permanently, except in accordance with section 24-89
(Garage apartments), and no accessory structure shall be used for any commercial or business purpose
unless approved as a home occupation in accordance with the provisions of section 24-159 of this
chapter.
This letter requests that the noted violation(s) be corrected by obtaining an valid building permit
for the existing shed and requesting inspections within ten (10) days of the receipt of this notice.
Please note that at no time may the shed be temporarily or permanently used as a residence.
Thank you for your cooperation in this matter. Failure to correct the violation by the required date may
result in this case being referred to the Code Enforcement Special Magistrate resulting in fines up to two
hundred fifty dollars ($250.00) per day. Upon completion of the action required, it is your responsibility
