Resolution No. 00-15 v RESOLUTION NO. 00-15 110 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, SUPPORTING THE JACKSONVILLE TREE PRESERVATION CHARTER AMENDMENT WHEREAS, a proposed Charter amendment commonly referred to and spoken of as the Tree Preservation Amendment,will appear on the ballot in Duval County on November 7, 2000; and WHEREAS,the chief purpose of the measure is to amend the Charter of the City of Jacksonville to add a new article to the Charter, providing minimum standards in Duval County for tree protection, conservation and mitigation during development; defining certain trees on development sites as "protected trees";providing exemptions for an individual lot on which a single-family dwelling or mobile home is located, exemptions for cemeteries, and exemptions for land being used for bona fide agricultural purposes; and WHEREAS,the City of Atlantic Beach is designated as a Tree City USA; and WHEREAS, the City of Atlantic Beach supports the findings, intent and purpose of the Tree Preservation Amendment,including the finding that"minimum"standards as set forth in the proposal for tree protection,conservation and mitigation during development are desirable environmental goals that will advance the quality of life for Duval County and its residents, and including the intent and purpose of the proposal to establish"minimum"standards for Duval County so as to promote the health,safety and welfare of the current and future residents of Duval County; and WHEREAS, the proposed Charter amendment provides that it shall not be construed to repeal or • modify any existing ordinance,and such stricter standards as currently apply within the City of Atlantic Beach shall continue in full force and effect; and WHEREAS,the City of Atlantic Beach, as a governing body of an urban service district, is given the right to enforce the provisions of the proposed Charter amendment,if adopted by the voters of Duval County; and WHEREAS, the City of Atlantic Beach, however, is not acknowledging by the passage of this Resolution that the proposed Charter amendment, if adopted by the voters of Duval County, would be applicable in the City of Atlantic Beach, and is not acknowledging that the City of Atlantic Beach would be required to enforce any provisions of the proposed Charter amendment; and WHEREAS,the residents ofthe City of Atlantic Beach have expressed their strong support of the Tree Preservation Amendment. NOW,THEREFORE,be it resolved by the City Commission of the City of Atlantic Beach,as follows: SECTION 1. The City of Atlantic Beach supports the Tree Preservation Amendment. SECTION 2. The passage of the Tree Preservation Amendment will advance the quality of life for Duval County and its residents, including the residents of the City of Atlantic Beach. 4110 SECTION 3. The minimum standards set forth in the Tree Preservation Amendment will - L promote the health, safety and welfare of the current and future residents of Duval County,Florida. illSECTION 4. This Resolution shall take effect immediately upon its adoption.
