Dear Mr. Wolfson,
This letter serves as confirmation that the property known as PT GOVT LOT 7 RECD O/R 5349-1108, having dimensions of approximately 70’ x 50’ and lying west of Garage Approach Roadway
as shown according to PLAT BOOK 15, PAGE 10, NORTH ATLANTIC BEACH UNIT NO 01, and recorded in the Public Records of Duval County on January 4, 1934, is a legally established non-conforming
lot of record. The property is zoned Residential General (RG) and is designated Residential, Low Density by the adopted Comprehensive Plan for the City of Atlantic Beach.
As such, Section 24-85(b)(1) of the Atlantic Beach Land Development Regulations (LDR) provides that the subject property may be developed with a single-family residence and typical accessory
structures, provided the minimum yard requirements for the RG Zoning District are maintained, or provided that the owner of the lot obtains a variance from the Community Development
Board in accordance with the requirements of Section 24-64 of the same LDRs. Sections 24-108(e)-(f) provide the minimum yard requirements and building restrictions for the RG Zoning
District as follows:

On non-conforming lots of record, the height of buildings shall be restricted to a percentage of the area of the subject lot as compared to the minimum lot area of the applicable zoning
district, and applied to the maximum building height for the same zoning district. In this case, it would be [(3500/5000) x 35], or 24.5’.
Also, please note that after the initial effective date of these LDRs (January 01, 2002), no lot or parcel in any Zoning District shall be divided to create a lot with area or width
below the requirements of these LDRs and the Comprehensive Plan [Section 24-85(b)(4)].
All other applicable land development regulations, building codes and permitting requirements, which are in effect at the time building permits are sought, shall apply to the development
