These standards are set forth in the International Property Maintenance Code and the Florida Building Code and were adopted as part of the City of Atlantic Beach Code of Ordinances in Chapter 6,Article II, Section 6-16. A code enforcement inspection at 1070 OCEAN BLVD was conducted on 2/9/2024. The City of Atlantic Beach Code Enforcement has found your property to be in violation of the City of Atlantic Beach Code of Ordinances: NATURE OF VIOLATION: 1. In accordance with code, any landscaping planted in the city's right of way and any landscaping materials planted within the required site triangle of a defined intersection must be maintained at a height not to exceed 30 inch. The 30 inch height limitation is measured from the grade of the roadway. The bushes and other materials planted between your fence and Ocean Blvd exceed 30 inches in height. The vegetation blocks the view of pedestrians and drivers approaching the intersection and creates a safety hazard. 2. Large stones have been placed adjacent to the roadway at the corner of 11th St. and Ocean Blvd. These create a hazard to turning vehicles and are prohibited by code. APPLICABLE CODES: Sec. 19-5. To ensure clear sight distance and adequate visibility at defined intersection,the owners or occupants of private real property shall be prohibited from any of following,which may obstruct a driver's view of traffic at such intersections. (1)Plant or permit the growth of shrubbery or any other vegetation within the city right-of-way higher than thirty(30)inches above the established grade of the right-of-way; Sec. 19-1.Construction of driveways and in rights-of-way. The construction of a new driveway in the city's right of way,or the modification of an existing driveway shall require construction permit within the city rights-of-way and easement.(c)Except as may be permitted in accordance with section 19-2 hereof,no person or entity shall undertake any use of or any type of construction within city rights-of-way, including without limitation,the following: 5. Barriers or obstructions of any kind. 16.Any work, construction activity or item which creates an obstruction,whether permanent or temporary,to the free and complete use of the right-of-way. Sec. 19-5. -Intersections: sight distance requirements and safety zones. (b)Safety zones. For purposes of this section, safety zone shall be defined as an unobstructed area along the edge of the roadway intended for the recovery of errant vehicles,and also the edge of sidewalks or designated pathways intended to provide for a safe area that is free of obstructions, which may create hazards for pedestrians, bicycles or vehicles. (2) Within private property. On any private property, no landscaping or vegetation other than lawn grass,and no property border, berm, retaining wall edging,timbers, posts or other type of obstruction shall be constructed, placed, or permitted to remain within two(2)feet of the edge of the roadway pavement or edge of sidewalk, or in any location that creates an obstruction or hazard to pedestrians, bicyclists or vehicles. ACTION TO CORRECT: This letter requests that the noted violation(s) be corrected within ten (10) days of the receipt of this notice by: 1. Removing the large stones from the right of way safety zone 2. Cutting back all vegetation to less than 30 inches in height and maintaining the height at no more than 30 inches Thank you for your cooperation in this matter. Failure to correct the violation by the required date may result in abatement action including removal of all vegetation by the City of Atlantic Beach and this case being referred to the Code Enforcement Special Magistrate resulting in fines up to two hundred fifty dollars ($250.00) per day.
