RESOLUTION NO. 87-17
A Resolution authorizing Eminent Domain proceedings to
acquire perpetual unobstructed easement for water and sewer
services over and under the hereinafter described property and
authorizing the City Attorney to file condemnation suit therefor;
providing an effective date .
Be It Resolved by the City Commission of Atlantic Beach as
follows :
1 . The City Attorney be and he is hereby authorized to
institute condemnation proceedings through exercise of the City's
Eminent Domain powers to acquire in the name of the City a
perpetual unobstructed easement over and under the following
described property for the purpose of constructing, maintaining
and operation of water and sewer lines to provide services to
properties adjacent to the easement :
That portion of Garage Approach Roadway
as shown on the map attached to the
Memorandum of Agreement recorded in Deed
Book 1051 at Page 98 of the current
public records of Duval County, Florida,
which lies south of a westerly projection
of the north line of the south half of
Lot 84; said parcel being one hundred
seventy- five feet , more or less , in
length and forty feet, more or less, in
width; and , said parcel being adjacent
to and bounded on the north by the south
line of the land described in Volume 4928
at Page 754 of said current public

records , and adjacent to and bounded on
the south by the northerly end of Garage
Approach Roadway as shown on the plat of
North Atlantic Beach Unit No. 3, R-C-B-S
Corporation, as recorded in Plat Book 15,
Page 93 of said current public records.
2. The City Attorney is hereby authorized to take whatever
legal action necessary to carryout provisions of this Resolution.
3. This Resolution shall become effective immediately.
