RESOLUTION NO. 72-37
WHEREAS, that certain alley in the City of Atlantic Be'd~h,
Florida, being bounded on the-South by Atlantic Boulevard, on
the North by Ahern Street, Atlantic Beach, on the East by Lots
4, 5, 6, 7 and 8, Block 36, ATLANTIC BEACH SUBDIVISION and on
the West by Lots 1, 2, 3, 9, l0 and 11, Block 36, ATLANTIC BEACH
SUBDIVISION, all as recorded in Plat Book 5, page 69, of the
current public records of Duval'County, Florida, has never been
developed, and
WHEREAS, the members of the City Commission of the City of
Atlantic Beach, Florida, feel it is in the best interest of
the citizens of the City of Atlantic Beach, Florida, to abandon
the said alley as described above, end
WHEREAS, the said alley is a Ten {10) foat right of way as shown
on the official City of Atlantic Beach map.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF ATLANTIC BEACH, FLORIDA, AS FOLLOWS:
1. That the City of Atlantic Beach, Florida, abandon that alley
bounded on the South by Atlantic Boulevard, on the North by
Ahern Street, Atlantic Beach, on the East by Lots 4, 5, 6, 7 and
8, Block 36, ATLANTIC BEACH SUBDIVISION,, and on the West by Lots
1, 2, 3, 9, 10 and 11, Black 36, ATLANTIC BEACH SUBDIVISION, all
as recorded in Plat Book 5, page 69, of the current public records
of Duval County, Florida.
2. The City of Atlantic Beach does hereby forever quit-claim all
right, title, interest, claim and demand in respect of said alley,
and will not be held liable in any way whatsoever in respect to
any interest, lien, eQUity or claim either in law or eQUity, in
respect of said alley.
3. This resolution is supplemental of that certain Resolution No.
72-3 adopted by the City Commission of the City of Atlantic
Beach, Flarida, on January 10, 1972, and this resclution is
adopted because the building permit referred to in said Resolution
No. 72-3 has been applied for and approved by this City Commis~ic~z.
