07-11-85 v MINUTES OF A SPECIAL CALLED MEETING of the BOARD OF ADJUSTMENT CITY OF ATLANTIC BEACH July 11, 1985 7:00 P.M. CITY HALL PRESENT: Chairman L.B. MacDonell Mrs. Dorothy Kerber Samuel T. Howie Frank J. Tassone John Bass AND: Richard C. Fellows, City Manager Rene' Angers, Secretary AND: Allan Wheeler Robert Callander (7:20) Chairman MacDonell called the meeting to order at 7:12 p.m. A roll call noted that all Board members were present. Chairman MacDonell stated that approval of the minutes of the meeting of June 15, 1985 would be deferred until the next meeting. Chairman MacDonell called the Board's attention to the business before the Board. A- L L JC J. L L J. 1. * J. * L L L JC OLD BUSINESS Request for Side Setback Variance - Lot 5, Block 39, Section H; by Allan Wheeler and Robert Callander; deferred from the meeting of June 15, 1985. Mr. Wheeler stated that he and Mr. Callander want to build a warehouse on the lot and that they were requesting a five foot variance on the east side setback. He stated that there would be an additional five feet on the west side (total 15') in order to have enough room to drive the trucks into the garage doors. Chairman MacDonell asked the Board for any questions or comments. Mrs. Kerber stated that the Board had asked the applicants at the last meeting to attempt to obtain letters from the immediate neighboring property owners stating that they had no objection to the variance. She asked if Mr. Wheeler had the letters. Mr. Wheeler stated that they had obtained the letters. He stated that Mr. Callander has the letters and that he had not been able to contact him to remind him of the meeting. Board of Adjustment July 11, 1985 Page 2 Mr. Wheeler stated that he had not been instructed to provide letters prior to the last meeting. Chairman MacDonell replied that having the letters is not a requirement for a variance. Chairman MacDonell asked how long they had owned the property. Mr. Wheeler replied that they have owned the property for almost one year. Chairman MacDonell stated that the present code was in effect when the lot was purchased and that they should have checked the zoning prior to purchasing it. He felt, however, that they were fringing on a hardship. He noted that the building next door, constructed under the old code, was permitted to build within 2' of the property line. He added that the applicants were attempting to abide by the "no outside storage" requirement for contractors in CG zoning and that they would have a hard time getting the trucks into the building with only a 10' wide drive. He felt there was justification in granting the variance. At that point Mr. Callander arrived and submitted the letters from the neighboring property owners. Mrs. Kerber inspected the letters and stated that they were all in favor of the variance being granted. There being no one else to speak for or against the request, Mr. Howie motioned that the request for variance be approved. Mr. Tassone seconded the motion which carried unanimously. During discussion Mr. Wheeler asked what could be done about the appearance of Larry's Upholstery Shop. The secretary stated that she would ask the Codes Enforcement Officer to inspect the property. MacDonell, Chairman July 8, 1985 Mr. Hall: Allan Wheeler and Robert Callander as owners of Lot 5, Block 39 are in the process of requiring a 5 foot setback variance in lieu of the required 10 foot setback on the east side of the property. The warehouse will be built with setbacks on the east side of 5 feet and 15 feet on the west side. You being owner of Lot 5, Block 38, which is adjacent to our property, do not object to the above mentioned variance and are in full agreement with the variance. Robert Callander Robert Hall Co-owner Lot 5, Block 38 Lot 5, Block 39 July 1, 1985 Mr. Steve Mabry: Allan Wheeler and Robert Callander as owners of Lot 5, Block 39 are in the process of requiring a 5 foot setback variance in lieu of the required 10 foot setback on the east side of the property. The warehouse will be built with setbacks on the east side of 5 feet and 15 feet on the west side.
