07-17-86 v `. . MINUTES OF THE BOARD OF ADJUSTMENT CITY OF ATLANTIC BEACH, FLORIDA JULY 17, 1986 7:00 P. M. CITY HALL Present : Louis B. MacDonell, Chairman Dorothy Kerber Samuel T. Howie John Bass Richard White And : Rene' Angers, Recording Secretary Walter J. Parks, IV William B. McMenamy Chairman MacDonell called the meeting to order at 7:00 p. m. He asked for a motion on the minutes of the meeting of June 19, 1986. Mr. Howie motioned that they be approved as presented. Mr. White seconded the motion which carried unanimously. NEW BUSINESS A. Request for Side Setback Variance - Lot 36, Block 11, Atlantic Beach Subdivision A; 377 Plaza; Walter J. Parks IV Mr. Parks stated that his upstairs apartment at 377 Plaza had a rear exit through the kitchen. He stated that the kitchen was of substandard height and that the doorway was very low. He stated that he had moved the doorway to the east side and constructed a deck from the door around to the rear of the apartment. He stated that the construction took place two years ago and that, at that time, he was not aware of the need to obtain a building permit. The deck extends 2. 6' into the 5' east side setback, leaving a setback of 2. 4' . Mr. Parks submitted a letter of approval from his neighbor to the east. The following property owners were present and spoke in favor of the variance: Lynn Raiser, 359 Plaza; Loraine Gibson, 363 Plaza; Lynn Robertson, 333 Plaza. Mr. White felt that the small opening for the doorway constituted a hardship, along with the fact that if the variance was not granted, Mr. Parks would have to remove the deck. Mr. Howie, in light of the fact that that the deck had been there for two years with no complaints, and the hardship suffered from the substandard height of the kitchen area, motioned to approved the variance subject to Mr. Parks obtaining an after-the-fact building permit for the deck and patio below. Mrs. Kerber seconded the motion which carried unanimously. * * * * * * .. B. Request for Lot Width Variance - Lots 11 & 13 (Ex. W 15' ) Block 12, Atlantic Beach Subdivision A; 328 10th Street ; Patricia Gearhard William B. McMenamy, 3238 Crosby Lane, Jacksonville; stated that he and Stephen Landon have a contract to purchase the property from Mrs. Gearhard. He stated that there presently is a house on the property and that it would be removed in order to construct two single family residences. He stated that they were requesting a variance of the 50' lot width requirement to build on 42. 5' lots. He added that with the lot depth of 130' , they would have more than the required 5, 000 square feet. The following residents spoke in opposition to the request : Mary Lindner, 340 10th Street ; Robert and Gloria Persons, 311 10th Street ; Fred Loomis, 345 10th Street ; Oliver Ward, 335 10th Street. Some of the reasons for opposing the variance included, the "already out of control parking on the right-of-way", property values would be decreased, setting a precedent for vacant lots on the block. The board received a petition from the neighbors stating their opposition to the variance, and a letter from Barbara Deckman, 319 10th Street, stating her opposition. Chairman MacDonell felt granting the variance, in effect, constituted rezoning the property from single family to duplex ; he questioned whether the board had authority to do that. There being no further discussion, Mr. Howie motioned to deny the request. Mrs. Kerber seconded the motion which carried unanimously. * * * * * * * * * * * * * * * * * * * * * There being no other business to come before the board, the meeting was adjourned at 7:25 p. m. L. MacDonell, Chairman Atlantic Beach, July 17, 1986 We, the people of the 300 block, Tenth Street, Atlantic Beach would like to petition aginst the variance requested by the owner of 328, 10th St. Atlantic Beach. We believe: 1 . It is against the by-laws of the City that 2 seperate, 1 family homes be erected on 1 , 85' lot. 2. Parking facilities would not accomodate parking for 2 families and guests. 3. This neighbourhood is considered residential 1 family homes, not commercial. 4.
