03-21-85 v MINUTES OF THE BOARD OF ADJUSTMENT CITY OF ATLANTIC BEACH, FLORIDA March 21, 1985 7:00 P.M. CITY HALL PRESENT: Chairman Louis B. MacDonell Mrs. Dorothy Kerber Mrs. Rose Blanchard Frank J. Tassone Samuel T. Howie AND: Rene' Angers, Recording Secretary AND: Vincent D. Akra George Bull, Jr. ABSENT: Richard C. Fellows, City Manager Chairman MacDonell called the meeting to order at 7:00 p.m. A roll call noted that all Board members were present. Chairman MacDonell asked if there were any comments or corrections to be made to the minutes of the meeting of February 21, 1985. Rose Blanchard motioned that the minutes be approved. Dorothy Kerber seconded the motion which carried unanimously. * * * * * J. J. J, * J. * * * * NEW BUSINESS Item #1 - Request for Side Setback Variance - Vincent D. Akra Mr. Akra stated that he was requesting a side setback variance to construct an addition onto his existing strip shopping center in the 1200 block of Mayport Road that would be 2.7' from the north side property line. He stated that when he built the existing building in 1960, the City had requested an easement in the rear of the property extending to Plaza. He stated that he had to purchase additional property from the adjoining property owner to comply with the request. Mr. Akra added that when he purchased the property in the 1960's there were no side setback requirements. He stated that the structure next door was built approximately 8' from the side property line, which would leave about 10' between the buildings. He stated that there was sufficient roam for fire protection on all sides of the addition. Chairman MacDonell felt that it was a hardship for Mr. Akra because the zoning had been changed since he purchased the property and because he had to purchase additional property in order to satisfy the requirements of the City. He added that some communities have no setback requirements for commercial property. Board of Adjustment March 21, 1985 Page 2 There being no further discussion, Mr. Howie motioned that the request be approved as presented. Mrs. Blanchard seconded the notion which carried unanimously. Item #2 - Request for Side Setback Variances - W. Sperry Lee, by George Bull, Jr. Mr. Bull stated that he was requesting a variance to build approximately 6.62' from the interior side property line at 1085 Beach Avenue, rather than 7.5' as required on corner lots. He stated that the code was inconsistent on corner lot setbacks, that an interior lot is required to have only a 5' side setback. He stated that he also requested a side setback variance on the exterior side to build a third story onto the existing structure that was built 14.2' from the property line, encroaching the required 15' . Mr. Bull stated that an existing deck, in violation of the rear setback, would be removed and that the structure would be changed from a duplex to a single family home. Doug Miller, 1098 Beach Avenue, stated that he was in favor of the variance requests and felt that the plan would be an asset to the neighborhood. There being no one else to speak on the matter, Mr. Howie motioned that the requests be approved.
