08-15-85 v w. MINUTES OF THE BOARD OF ADJUSTMENT CITY OF ATLANTIC BEACH August 15, 1985 7:00 P.M. CITY HALL Present: Louis B. MacDonell, Chairman Mrs. Dorothy Kerber John Bass And: Richard C. Fellows, City Manager Rene' Angers, Secretary And: M . and Mrs. Earl B. Hooten, II Absent: Frank J. Tassone Samuel T. Howie Chairman MacDonell called the meeting to order at 7:14 p.m. After a roll call the Chairman asked for any comments or corrections to be made to the minutes of the regular meeting of June 20, 1985. Mrs. Kerber motioned that they be approved as presented. Mr. Bass seconded the motion which carried unanimously. The Chairman asked if there were any comments or corrections to be made to the minutes of the special-called meeting of July 11, 1985. Mrs. Kerber motioned that they be approved as presented. Mr. Bass seconded the notion. It carried unanimously. Chairman MacDonell called the Board's attention to the New Business at hand. NEW BUSINESS Request for Variance - Earl B. Hooten, II - 172 Sixth Street Chairman MacDonell stated that the Board had received a letter from the Codes Enforcement Board regarding the hardship of the Hooten's property. He recognized Mr. Hooten and asked him to address his request for variance. Mr. Hooten stated that he had been directed to the Board of Adjustment by the Codes Enforcement Board. He gave the following account of the history of the deck on his property: When he purchased the property there was a porch and two stairwells in the front of the house. He had them inspected and they were determined to be rotted and unsafe. He came to City Hall and told the officials that he wanted to re-construct the deck and extend it on both ends. The City placed a stop- work order on the property when a lip was extended out towards the street. He came back to City Hall and told the officials that if the problem was with the lip extension, he would saw it off and bring it back to the poles where the original footings were. As he proceeded to remove the lip, a new city manager placed another stop-work order on the property. He stated that he could get no cooperation from the new city manager on the matter, and that the deck has been in its present state since that time. (The new city manager referred to was A. William Moss.) Board of Adjustment August 15, 1985 Page 2 Mr. Hooten stated that he presently has no front entrance to his home and that he would like to be permitted to remove the lip, bring the deck back to the columns, and construct one set of stairs on the east side. Mrs. Kerber stated that she hoped he would be willing to have just enough there for the width of the stairs and a small landing, possibly brought out to the edge of the existing eaves, which only encroach 2.4' over the property line. Mr. Hooten felt that the deck would have to extend to the columns for adequate support. Mr. Bass asked the dimensions of what would extend over the City right-of- way. Mr. Hooten replied that he could remove 31/2 and possibly 4 feet of the deck. The Board agreed that they wanted to know exactly how far the deck would extend over City right-of-way if it was removed to the columns. There was a brief recess as Chairman MacDonell and Mr. Hooten went to the property to take measurements. * * iV * * * * * * * * * * n i. i. * Chairman MacDonell stated that the outside face of the columns are approximately 7' from the north side of the house. The colo ns are 1.3' from the eave line (which encroaches 2.4' over the property line) . Chairman MacDonell perceived the necessary encroachment over the City right-of-way to be 3.7' . There being no further questions or comments Chairman MacDonell asked for a notion. Mrs. Kerber motioned to allow the deck and one set of stairs, facing the east, with no more than a four foot encroachment on City right-of-way.
