Chairman MacDonell called the meeting to order at 7:01 p.m. He asked for
comments or corrections to be made to the minutes of February 20, 1986.
Dorothy Kerber asked that a correction be made on the spelling of Mr. Howie's
last name. There being no futher corrections Mr. Howie motioned to approve
the minutes as corrected, Mr. Bass seconded the motion which carried
unanimously.

NEW BUSINESS
Chairman MacDonell explained to all present that there had been considerable
debate over the items on the agenda for this meeting. The Board had considered
postponing the meeting until they could obtain a decision from the City Commission
regarding Covenants and Restrictions in effect in Selva Marina and Selva Tierra
subdivisions. The Board felt that at this point they could not act upon request
for variances for homes in these areas because they had not been given authority
to grant them a variance from the City code, Chairman MacDonell explained to
the audience that if they were willing to postpone any action by the Board,
that they would be placed on next months agenda and at that time the Board would
have an answer from the City Commission and be able to act on their requests.
The action coming from the City Commission was expected to be in the form of
an ordinance or signed release that would absolve the City from any liability
from lawsuits from other homeowners in their developments.
The Board addressed questions from the audience. Those present who had requested
a variance asked questions basically clarifying the information given by
Mr. MacDonell. Mrs. Pyell questioned the fact that she had received a letter
granting her an administrative variance and that if she hadn't called she would
not have come to the meeting and would have gone ahead and made plans to build
the patio based on the information received in the letter. The Board explained
that there had been an error in issuing the letter and that the City did not have
the authority to grant an administrative variance for areas of the city covered
by Covenants and Restrictions.

A motion was made to defer all cases to the next meeting and adjourn, by
Mr. Howie. Dorothy Kerber seconded the motion which passed unanimously.
The meeting was adjourned at 7:45 p.m.
