Dear Sonja,
I appreciated the opportunity to speak to you last week. With regard to the above
referenced property please confirm the possibility of developing this parcel as condo
units. Some questions come to mind.
1. Can access remain the existing 16'easment along Beach Avenue?
2. Does the possibility exist to have duel access- one on Beach Avenue (without
necessity to control the additional beach access lot) and one on Seminole?
3. With the approximate land square footage of 22,283 is it correct to assume in
medium density zoning that the requirement is 3100 square feet per unit, thus
22,283/3100 or 7 units will be allowed on this property.
4. Please confirm the setbacks for both the project and the buildings proximity to
each other.
5. Allowable impervious area is what percentage?
One of the concerns I do have with the decision as classification of condominiums is
the necessity to involve any other governmental agencies for parts of development such
as paving and drainage, retention, utility, master designs, etc. If due to the small site, we
are reviewed the same as would be with duplexes or other small multifamily buildings
(without master retention) and simple utilities a project might become feasible here.
As always I appreciate you and can assure you that if we can move forward with a
project, we will develop something the city will be proud of. I do not have this property
under contract and appreciate this correspondence to be confidential as you can within
your guideline .

driveway access would access the required 12 internal parking spaces.) The requirement of the parking regs, Sec.

impervious to require. I don't know what other standard we could use, though.

Dear Mr. Sones:
I write in reply to your attached letter. The property you have inquired about involves portions of
two lots with a zoning designation of Residential General, Multi-family (RG-2). The
Comprehensive Plan Future Land Use designation of this property is Residential, Medium Density.
Single and two-family, or multi-family/condominium use, of this property is consistent with the
zoning designation, subject to the density limitation of the adopted Comprehensive Plan. The
Medium Density category requires 3100 square feet of lot area per dwelling unit. You have
indicated that the land you are interested in developing contains 22,283 square feet of lot area; as
such, seven (7) units would be permitted, subject of course to other applicable permitting
requirements.
As we have discussed, portions of these two platted lots have been previously developed in a manner
that is not consistent with re-division and access requirements of our current subdivision regulations.
It appears that a 16-foot wide easement currently functions as a private driveway for the single-
family residence located between Beach Avenue and Seminole Road. You have questioned whether
this access from Beach Avenue could be used to provide proper access to new development on this
property. The City's subdivision regulations provide standards for residential right-of-ways and
alleys, and the parking regulations require a width of 22-feet for two-way driveways. It is my
opinion that neither of these standards are clearly applicable to the type of development you are
proposing. Since you are not proposing to re-divide or re-plat the property, or to create any
dedicated right-of-ways, the cul-de-sac standards would not seem applicable, and it its my
interpretation that the 22-feet width required for two-way driveways, as included in the parking
regulations is intended for commercial developments. It is my understanding that the access you are
proposing would be a privately maintained driveway, established through a non-exclusive access
easement to which each condominium homeowner would be a party, and further that there is not an

intent to divide these units into fee-simple lot divisions. I wish to caution that if this manner of
development is considered, the project would be subject to applicable provisions of the subdivision
regulations.
The Public Works Director has suggested that for this type of driveway, a special design, consisting
of a driveway of twelve (12) foot-width with "relief areas" on each side might be appropriate. My
recommendation would be that you submit a preliminary or conceptual design to Bob Kosoy for his
review and approval. I would also advise, that since this is an issue not clearly addressed in the
City's land development regulations, I will likely propose standards to address such situations in
future amendments to the regulations. Should you proceed with this project, the development would
be subject to any requirements in effect at such time permits are sought.
In regard to setbacks and Impervious Surface Area, I have enclosed a copy of Section 24-107, which
establishes these standards. The requirement for separation between structures located on the overall
development parcel will be as required by the Florida Building Code. Please feel free to call me at
