Permit Clippership Lane 522 (2) 1. Upon the terms and conditions herein contained, the City agrees to provide potable water and domestic sewer services to the User's Property. The term "domestic sewage" used in this paragraph and referred to throughout this Agreement is defined as follows: Hunan waste including liquids and solid matter carried from plumbing fixtures normally carried off by drains and sewers, and except where specifically excluded bath and toilet wastes, laundry wastes, kitchen wastes and other similar wastes. It does not include commercial or industrial waste. 2. City agrees that after User has connected to the system, thereafter City will provide, at its costs and expense, but in accordance with other provisions of this Agreement, including rules and regulations and rate schedules, sewer service and water service to User's Property in a manner conforming to reasonable requirements of public governmental agencies having jurisdiction over City's water and sewer operations, 3. User shall, at its costs and expense, install all of the potable water distribution and domestic sewage collection lines which may be required on User's property, including engineering cost, to connect City's plant to' the User's property, and all other facilities necessary to make it possible for the City to provide adequate potable water and domestic sewage service. Mizell , applied to the Community Development Board for a Variance to permit the construction of a glass and brick room addition to the rear of their residence which would encroach the rear setback requirement by ten feet . The purpose of the addition was to house a billiards table and as a recreation room. The Board denied the application. The Mizell ' s appealed and the Commission denied the appeal . The Mizell ' s redesigned the addition to be a roof over the patio with no walls of any kind, and resubmitted the application to the Community Development Board. At the meeting the Board considered the question of substantial difference and found by a. vote of 4-1 that this request was substantially different and that the application would be considered for action. During discussion the Board found that this addition was not an accessory building and that no hardship existed. It was further discussed that if the addition were redefined to be an accessory building the applicant would then be in violation because of another existing free standing storage building on the lot . The Board voted to deny the variance request . Mrs . Mizell has again appealed their denial . RECOMMENDATION: Staff recommends that this appeal be denied based upon the lack of apparent hardship, and that the granting of this variance would confer upon the applicant a special privilege denied by the Zoning Code to other lands in the same district , namely a ten foot rear setback requirement . Mizell , applied to the Community Development Board for a Variance to permit the construction of a glass and brick room addition to the rear of their residence which would encroach the rear setback requirement. by ten feet . The purpose of the addition was to house a billiards table and as a recreation room. At the hearing , the Board found that no hardship existed that justified the proposed encroachment . It was pointed out by staff that the problem derived from the original placement of the house on the site , which, although fully in compliance with setback regulations at the time , did not leave any room for future expansions . RECOMMENDATION : Staff recommends that this appeal be denied based upon the lack of apparent hardship, and that the granting of this variance would confer upon the applicant a special. privil.ege denied by the Zoning Code to other lands in the same district. , namely a ten foot rear setback requirement . The setback requirement is twenty feet . The proposed addition is to accommodate a pool table . RECOMMENDATION: At the time of the original building construction the required setbacks were in compliance but the layout of the site placed the rear corner of the building at the setback line leaving no room for expansion. Upon motion duly made and seconded said minutes were approved. NEW BUSINESS.- I . USINESS:I . Application for ,Variance filed by John B. Mizell , Jr . to construct a glass/screened room with a rear setback of 10 feet on property located at 522 Clippership Lane . Dean Brymer , builder for the applicants, introduced himself to the board and explained that a variance was requested to construct a recreational glass Florida room to be attached to the facia of the home and stated the purpose of tha addition was for a pool table . After discussion , Air . Wolfson moved to grant the variance. The motion was seconded by Mrs . Gregg and failed by a vote of 4 -2 . II . The board discussed the matter of reducing the minimum lot requirements . Mr . Wolfson stated that this item was placed on the agenda at his request because of the 50 ' x 50 ' lots on Beach Avenue that the City Commission was allowing owners to build upon by granting variances . The board also discussed the matters of accessory structures and buildings and the definition of these terms . No resolution was reached on either issue . I After discussi.on., Mr . Wolfson moved to request a workshop between the City Commission and the Community Development. Board to discuss these matters . Mrs . Walker seconded the motion and it was passed unanimously. Mizell , applied to the Community Development Board for a Variance to permit the construction of a glass and brick room addition to the rear of their residence which would encroach the rear setback requirement. by ten feet. The purpose of the addition was to house a billiards table and as a recreation room. At the hearing , the Board found that no hardship existed that justified the proposed encroachment. It was pointed out by staff that the problem derived from the original placement of the house on the site , which, although fully in compliance with setback regulations at the time , did not leave any room for future expansions . RECOMMENDATION: Staff recommends that this appeal be denied based upon the lack of apparent hardship, and that the granting of this variance would confer upon the applicant a special privilege denied by the Zoning Code to other lands in the same district , namely a ten foot rear setback requirement .
