05-21-96 v MINUTES OF THE COMMUNITY DEVELOPMENT BOARD OF THE CITY OF ATLANTIC BEACH, FLORIDA MAY 21, 1996 7:00 P.M. CITY HALL PRESENT • Don Wolfson Robert Frohwein Mary Walker Mark McGowan Sharette Simpkins AND ▪ George Worley, II, CD Director Alan Jensen, City Attorney Pat Harris, Recording Secretary ABSENT • Pat Pillmore Buzzy Grunthal Don Wolfson, called the meeting to order and asked for the approval of the minutes from the meeting of April 16, 1996. Upon motion duly made and seconded the minutes were approved. NEW BUSINESS: I. Application for Variance filed by Roger W. Olson to enlarge an attached structure at property located at 817 Amberjack Lane. Roger Olson introduced himself to the board and explained that he desired to enlarge an existing nonconforming storage area from 6' x 10' to 10' x 12' . He stated the nonconformance of the structure existed when he purchased the property and the construction would not encroach further toward the rear lot line than the existing nonconformance. After discussion, Mr. McGowan moved to grant the variance as requested. Mrs. Walker seconded the motion and the variance was granted by a vote of 4 ayes and 1 nay by the Chairman who stated he saw no hardship. II. Application for Variance filed by Rallis L. Pappas to permit an existing tree house at property located at 93 Oceanside Drive. Mrs. Pappas introduced herself to the board and explained that the tree house was constructed in the side yard of the residence without being aware that a permit was required and that the structure encroached the side yard setback. The property is located on a corner lot and the side yard setback is fifteen feet. Mrs. Pappas presented photographs to the board of the tree house. After discussion, Mr. McGowan moved to grant the variance. Mrs. Simpkins seconded the motion and the variance was granted by a vote of 3 ayes and 2 nays. The board decided to meet at 6:00 on June 18, 1996 just prior to the regular meeting to discuss the proposed amendments to the zoning codes. Mr. Worley stated he would confirm said meeting before that time. The board discussed hardship and expressed its desire to stress its definition and usage in the variance process.
