12-15-92 v MINUTES OF THE COMMUNITY DEVELOPMENT BOARD OF THE CITY OF ATLANTIC BEACH, FLORIDA December 15, 1992 7 :00 P. M. CITY HALL PRESENT Gregg McCaulie Ruth Gregg Don Wolfson Robert Frohwein AND Alan Jensen, City Attorney George Worley, II, CD Director Pat Harris, Recording Secretary ABSENT Samuel Howie Mark McGowan Pat Pillmore Chairman Gregg McCaulie, called the meeting to order and asked for approval of the minutes from the meeting of November 17, 1992. Upon motion duly made and seconded said minutes were approved. NEW BUSINESS: I. Application for Variance filed by New Community Baptist Church to construct an addition to the church which will encroach the setback requirements on property at 84 Lewis Street; Reverend James R. Jennings introduced himself to the board and stated that the congregation had grown from 4 to over 100 members in the last year and additional space was required by the church to accommodate the membership. After discussion Don Wolfson moved to grant the variance on the condition that the adjoining lot also owned by the church be combined with the lot on which the church is situated and the addition be constructed in an L shape so that the addition does not encroach the required rear yard setback. Mrs. Gregg seconded the motion and the variance was unanimously granted. II. Application for Variance filed by Robert B. Persons, Jr. , and Gloria M. Persons construct an addition to a non-conforming structure located at 311 Tenth Street. Mr. Persons introduced himself to the board and stated the reasons a variance was requested. He presented letters from neighbors stating their approval of the proposed construction. After discussion the board determined that the addition would not increase the nonconformance. Ms. Gregg moved to approve the variance as submitted. Mr. Frohwein seconded the motion the variance was unanimously granted. III. Application for Variance filed by Mary Dorsett and Martha Fischer to construct a detached garage which will encroach the rear and side yard setback requirements on property located at 1070 East Coast Drive. Kenneth Gaskill, builder for the applicants, introduced himself to the board and explained the reasons the variance was requested. Ms. Dorsett also introduced herself to the board as owner of the property. After discussion related to possible alternatives, the applicants requested that the application be deferred until the next regularly scheduled meeting at which time they would submit an amended application. The board agreed to the deferment. IV. Application for Variance filed by Willis Contractors, Inc. , on behalf of Robert and Minnie Vannoy to construct a pool enclosure that encroaches the side yard setback requirement on property located at 2009 Selva Madera Court. David Willis introduced himself to the Board and explained that the construction of the house had been altered to save a large tree on the property at the request of the Tree Conservation Board and a variance was needed to build the pool enclosure. After discussion Ms. Gregg moved to approve the variance. Mr. Frohwein seconded the motion and the variance was unanimously granted. Mr. Wolfson reported that two items previously denied by the Community Development Board and appealed to the City Commission were upheld by the City Commission because it was determined that the Community Development Board had acted legally and complied with the City ordinances. He also noted that two additional appeals were scheduled for the first Commission meeting in January.
