08-16-88 v MINUTES OF THE COMMUNITY DEVELOPMENT BOARD OF THE CITY OF ATLANTIC BEACH, FLORIDA August 16, 1988 7:00 P. M. CITY HALL PRESENT: W. Gregg McCaulie, Chairman ( 7 :30) Louis B. MacDonell, Vice Chairman Samuel T. Howie Ruth Gregg Kathleen Russell AND: Richard Fellows, City Manager Rene' Angers, Recording Secretary AND: Sharon Shaughnessy Gordon Anderson and Frank Gamel P. K. Breeding Bradley Gustafson William Collins ABSENT: John Bass Donald Tappin Vice Chairman MacDonell called the meeting to order at 7:08 p. m. He asked for comments or corrections to the minutes of the meeting of June 21, 1988. There being none, Mrs. Gregg motioned that they be approved. Mrs. Russell seconded the motion. The motion carried unanimously. The Vice Chairman asked for comments or corrections to the minutes of the meeting of July 20, 1988. There being none, Mrs. Russell motioned that they be approved. Mrs. Gregg seconded the motion, which carried unanimously. * * * * * NEW BUSINESS A. APPLICATION FOR FREE LANCE PHOTOGRAPY AS A HOME OCCUPATION - 103 WEST THIRD STREET; SHARON SHAUGHNESSY Mrs. Shaughnessy was present and stated that there was nothing further she wished to add to her application. There was no one present to speak against the application. Mr. Howie motioned to recommend approval of the application. Mrs. Gregg seconded the motion. Mrs. Russell questioned whether there would be any signage, employees other than herself, or customers coming to her home. Mrs. Shaughnessy replied that there would be no signs or employees and that the only customers she anticipated coming to her home would be an occasional bride for a portrait. There being no further discussion, the vote was called. The motion to recommend approval carried unanimously. B. APPLICATION FOR CORNER SIDE YARD VARIANCE IN A PLANNED UNIT DEVELOPMENT - LOT 2, BLOCK A, SELVA MARINA UNIT NO. 10; 491 SATURIBA DRIVE; GORDON ANDERSON Frank Gamel, contractor, stated that Mr. Anderson was seeking a variance of the covenants to shift the house closer to (within 15' of) North Sherry Drive in order to save two 24" oak trees. He added that the zoning code provides for 15' side yards on corner lots, but that this lot falls within a PUD that calls for 20' . There was no one present to speak against the application. Mr. Howie motioned to approve the application. Mrs. Russell seconded the motion which carried unanimously. C. APPLICATION FOR EXCEPTION FOR ADULT DAYCARE FACILITY - 1050 MAYPORT ROAD; PARTS OF BLOCKS 42 AND 43, SECTION H; FIRST BAPTIST CHURCH OF ATLANTIC BEACH Nurse P. K. Breeding stated that there is a great need for adult daycare in the beaches area. She stated that, without advertising, she already has four applicants for the center. She added that the church had previously been approved for a child daycare center. After brief discussion Mrs. Gregg motioned to recommend approval of the application. Mrs. Russell seconded the motion which carried unanimously. D. APPLICATION FOR SIDE YARD VARIANCE - 1505 PARK TERRACE EAST; LOT 1, BLOCK 4, SELVA MARINA UNIT NO. 2; BRADLEY GUSTAFSON Mr. Gustafson stated that they were seeking a variance in order to construct a screen swimming pool enclosure within 4' of their side property line. Mr. Gustafson 's affected neighbors were present and indicated that they had no objection to the variance and felt it would be an attractive addition to their home. There was no one present to speak in opposition of the application. Mrs. Gregg motioned to approve the application. The motion, which was seconded by Mr. Howie, carried unanimously. E. APPLICATION FOR EXCEPTION FOR AUTOMOTIVE SERVICING IN A COMMERCIAL LIMITED DISTRICT - 1211 MAYPORT ROAD; PART OF CASTRO-Y-FERRER GRANT; WILLIAM J. COLLINS Mr. Collins stated that the property is currently grandfathered- in under a previous zoning classification that allowed automotive servicing but that in order to retain the grandfathered status the current structure would have to be utilized. He stated that Amoco Oil has proposed tearing down the existing structure to build a convenience food/service station on the site and that they need an exception to be able to construct a mini-self serve type carwash to be used in conjunction with the primary use. After brief discussion, Mr. Howie motioned to recommend approval of the application. Mrs. Gregg seconded the motion which carried unanimously. * * * * MISCELLANEOUS BUSINESS The City Manager stated that he had been asked to present to the board a preliminary subdivision review for Edward Ash. Mr. Fellows gave each member a copy of a survey of the property and a proposed lot layout of the subdivision. The property is located on Seminole Road, between Sea Gardens and Ocean Village. Mr. MacDonell reminded the board that this property had been involved in litigation while in the City of Jacksonville and that a judge had over turned Jacksonville's decision to not allow development of high-rise condominiums. No board members expressed objection to the proposal. Mr. Fellows stated that the project would be formally presented to the board at their next meeting. * * * * * There being no further business to come before the board, Mr. Howie motioned to adjourn.
