06-16-87 v MINUTES OF THE COMMUNITY DEVELOPMENT BOARD CITY OF ATLANTIC BEACH, FLORIDA June 16, 1987 CITY HALL Present: W. Gregg McCaulie, Chairman Louis B. MacDonell, Vice Chairman Samuel T. Wilson Absent : John Bass The meeting was called to order at 7 :07 p. m. Chairman McCaulie asked for a motion on the amended minutes of the meeting of May 19, 1987. Mr. Tappin motioned to approve the amended minutes as presented. Ruth Gregg seconded the motion, which carried unanimously. * * * * * NEW BUSINESS A. Application for Variance to allow an Accessory Structure in the Front Yard, on Zero Lot Line; South 1/2 of Lot 46, Ocean Grove Unit II, 1753 Seminole Road, by Howard S. Brown Mr. Brown presented the Board with photographs of an existing concrete parking pad/driveway that he wished to cover with an open, detached carport. He proposed to extend the carport to the front property line. He replied to questions from the Board members that - he had been parking in this area since 1975; that his neighbors had no objections; and that the structure would be 38. 5' from the edge of Seminole Road asphalt. Mr. MacDonell was concerned with allowing a structure to be built directly on the right-of-way line. He brought up the point that Seminole Road may be widened in the future. Ruth Gregg expressed concern that the carport could later be closed-in and become living area. She also felt that the building is part of a row of almost identical buildings and that a detached structure in front of one of the units could disrupt the architectural intent. The Board addressed the findings of fact. Chairman McCaulie felt that the application did not meet the criteria of the findings of fact and that it would set a precedent. Chairman McCaulie motioned to deny the application for variance. Vice-Chairman MacDonell seconded the motion. Mr. Delaney stated that cars have been parked on the pad for more than ten years and that the structure would be hidden by hedges. Mr. Brown added that it was necessary to move the structure to the front of the lot due to the location of the septic tank and drainfield-that it could not be paved over. Mr. MacDonell suggested that Mr. Brown consult an engineer regarding permeable pavement over the septic tank and drainfield. The vote was called. The motion to deny the application for variance carried unanimously. B. Application for Rezoning of Lots 1, 2, 21, 22, Block 4, Atlantic Beach Villas Unit II ; from CPO Commercial Professional Offices to CL Commercial Limited, by Universal Builders, lnc. David Wilson, 7972 Green Glade Road, Jacksonville, stated that he wished to rezone his property on Mayport Road, between Saratoga Circles North and South to Commercial Limited in order to be able to offer light retail support facilities to his office building. He stated that this would broaden the marketing base. Mr. William Kirkpatrick, 95 Saratoga Circle, stated that there are covenants and restrictions, that are automatically extended every ten years, that provide for single family dwellings on the subject property. Mr. Don Johnson, 110 Saratoga Circle-directly behind subject property, expressed concern over the close proximity of the structure to his bedroom window, and was concerned that the rear setback area would be used by vagrants. He did feel, however, that some type of development was needed on the property. Several residents of the area expressed concern that he may later ask for exceptions to open a restaurant, service station, bar. Mr. Wilson replied that he did not have the facilities or parking for that type of operation. Mr. Tappin felt that the original intent of the area was CPO and that it should be left as it is. Mr. MacDonell suggested possibly adding the first five permitted uses of CL to CPO and retaining the CPO classification on the property. Mr. Gerald Saxton, 60 Saratoga Circle, was upset that the zoning had been changed from RS1 to CPO. He stated that he had been told that he would be personally notified of a possible zoning change. Mr. Roy Flournoy, 63 Saratoga Circle wanted "everything stopped and go back to single family" zoning. Mr. MacDonell suggested that Mr. Wilson withdraw the application to allow the Board time to consider modifying the permitted uses of CPO. He added that there was a one year waiting period if the application is denied. Chairman McCaulie suggested that the application be deferred rather than withdrawn, to keep the item active. Mr. Howie motioned to deny the application for rezoning. Mr. Tappin seconded the motion. Mr. Wilson asked that his application be deferred until the next meeting. Chairman McCaulie felt that an item should be deferred if the applicant feels he can come back and address the concerns of the citizens and the Board members. Chairman McCaulie made a substitute motion to defer action on the application for rezoning. Mr. MacDonell seconded the motion which carried unanimously. Chairman McCaulie informed the audience that the item would be re-considered at the next meeting and hoped the Board, citizens and the applicant would come back with some ideas that would alleviate some of the concerns that had been brought up. * * * * * MISCELLANEOUS BUSINESS There being no miscellaneous business before the Board, the meeting was adjourned at 8:20 p. m.
