10-20-87 v MINUTES OF THE COMMUNITY DEVELOPMENT BOARD CITY OF ATLANTIC BEACH, FLORIDA October 20, 1987 CITY HALL 7:00 P. M. PRESENT: W. Gregg McCaulie, Chairman (7: 10) Samuel T. Howie Ruth Gregg John Bass Donald Tappin Frank Delaney AND: Rene' Angers, Recording Secretary AND: Steve Cissel Pete Dowling ABSENT: L. B. MacDonell, Vice Chairman The meeting was called to order at 7 :03 p. m. by Mr. Howie who was asked to assume position of Chairman in Chairman McCaulie and Vice-chairman MacDonell 's absence. Mr. Howie asked for comments on the minutes of the the meetings of August 18th and September 15th. Mr. Delaney motioned that the minutes of August 18, 1987 be approved as presented. Mr. Tappin seconded the motion which carried unanimously. Mr. Delaney motioned to approve the minutes of the September 15, 1987 as presented. Upon second by Ruth Gregg, the motion carried unanimously. Chairman McCaulie arrived at 7: 10 and assumed the chair. NEW BUSINESS A. Application for Variance of Yard Requirements to Reconstruct a Secondary Dwelling - 1785 Beach Avenue; Lot 38, North Atlantic Beach Unit No. I - by Stephen and Ellen Landon Mr. Steve Cissel, 407 Seaspray Avenue, Atlantic Beach, stated that, as builder, he represented the Landon' s in their request. He presented the board with a current survey of the property and provided graphic representation on a display board. He stated that they were issued a building permit on April 14, 1987 and obtained foundation and rough plumbing inspections. He indicated that plans called for raising the structure off the foundation and then replacing it in a more "squared" position on the same foundation. Upon raising the structure they discovered major termite damage and decided to demolish - and re-construct the structure. He was not aware that by doing so they would have to comply with the current setback requirements. He stated that there would be adequate egress to the primary dwelling from the street, 7. 4' open space on the north side; and that adequate offstreet parking is provided across the street. He stated that the Landon 's have owned the property for many years and that they would maintain ownership of the secondary dwelling. Mark Kredell, 1851 Beach Avenue, stated that he had a similar request for variance come before the board and that his request had been denied. Mr. Howie replied that this was a different circumstance. He added that Mr. Kredell had purchased his lot knowing the restrictions. Mr. Delaney pointed out that Mr. Kredell 's lot is 50'x 50' and that the Landon' s lot is 50'x 246' . Mr. Howie felt that they would be making an improvement to the neighborhood. He motioned to approve the application. Mr. Bass seconded the motion, which carried unanimously. B. Application for Concept Approval - SEMINOLE SHORES NORTH (SEMINOLE REACH) by Mike Akel Pete Dowling representing Mr. Akel stated that they had submitted a plan very similar to the plan that had been issued concept approval by the board on August 18, 1987. He stated that they had not presented the first plan (OCEANSIDE) to the Commission because they wanted to submit them simultaneously. He added that the original proposal reduced density from 28 multi-family units to 12 single family units and that this proposal, renamed SEMINOLE REACH, reduced density from 20 multi-family units to 7 single family units. Keith Meiser, 2317 Seminole Road, asked whether the development would be regulated by the Subdivision Requirements or by the PUD Requirements. Mr. Dowling replied that some city officials had expressed concern over reducing the PUD acreage requirements-that it may open a "box of problems", and that the City Attorney suggested that the development be handled as a Development Proposal, consistent with the Growth Management Act of 1986. He was unsure of the specifics but assured Mr. Meiser that the details of the project would have to be agreed upon by the city, including an up-front landscape package and design quality standards. He added that he had a preliminary package together but that it was not ready to submit at this time. Sam Jacobsen asked if a zoning variance would be required due to the proposed 7. 5' side yards. Rene' Angers replied that side yards for single family construction are a minimum of 7. 5' while multi-family construction requires minimum side yards of 15' . Mr. Delaney suggested that Mr. Dowling provide the neighbors with a copy of the package at least three days prior to being presented to the City Commission. Mr. Howie motioned to issue concept approval as presented, subject to further information being provided to the interested neighbors. Mr. Delaney seconded the motion, which carried unanimously. * * * * * MISCELLANEOUS BUSINESS There was no miscellaneous business brought before the board.
