02-19-85 v MINUTES OF THE ADVISORY PLANNING BOARD CITY OF ATLANTIC BEACH February 19, 1985 7:00 P.M. CITY HALL Present: W. Gregg McCaulie, Chairman Guy M. Jennings Ron D. Gray Ruth Gregg Commissioner John W. Morris, Jr. And: Richard C. Fellows, City Manager Rene' Angers, Recording Secretary And: Chuck James Robert Gittings James Jaffa Chairman McCaulie called the meeting to order at 7:00 p.m. He asked if there were any comments or corrections to be made to the minutes of the January 15, 1985 meeting. There being none, Ron Gray motioned that the minutes be approved as presented. Ruth Gregg seconded the motion which carried unanimously. * * '* iC ** J* i* ** ** ** iC iC i* ** V iL * * * NEW BUSINESS Item V1 - Request for Rezoning - Bull Brothers, L.T.D. Chuck James, Ahern and Associates, stated that he represented the petitioners in the request for rezoning. He stated that the property is located on the east side of Mayport Road at Assissi Lane. He stated that they requested two zoning classifications; Commercial General fronting Mayport Road and RG-3 Multi-Family east thereof. The commercial area would be used for a motel. The franchise is owned by Quality-Comfort Inn. The motel would have a maximum of 108 roams. Fred Adams, 1860 Live Oak Lane, introduced himself as one of the owners. He stated that Quality Inn had expressed a desire to also have a 24 hour breakfast type restaurant on the property. At that point Ron Gray declared a conflict of interest and stated that he would not vote. Chairman McCaulie asked what was anticipated for the RG-3 area, parcel B. Mr. James replied that it would be apartments and that the only access to the development would be from Mayport Road. Commissioner Morris asked if the parcels would be developed simultaneously and what the time frame would be. Mr. James replied that they would not be developed simultanesouly and they could not presently commit to a time. Advisory Planning Board February 19, 1985 Page 2 Guy Jennings asked what was planned for the storm drainage through the property. Mr. James replied that the City's engineers would dictate the requirements. He added that there is a ditch that runs through the property that controls some of the drainage in Atlantic Beach and that the City may desire an easement. Ron Gray stated that he was against the proposal in light of the fact that the Board is reviewing the overall zoning of the entire Mayport Road corridor. Chuck James replied that their plan is compatible with the recommendations of the City of Jacksonville's Planning Department, adding that the boumdar.ies were changed due to the ditch. Commissioner Morris stated that he had no problem with the motel on the site, but he may argue the RG-3 zoning due to the density. Ron Gray asked what they could do under the existing sewer moritoriun. Mr. James replied that they could begin construction with the contingency that they hook up when the moritoriLml is lifted. Louis MacDonell, 1535 Selva Marina Drive, stated that the pattern on Mayport Road is that it is going to be some type of commercial. He felt that the CG would be a good buffer to the RG-3 area and that the drainage ditch would be a good buffer between the two. He added that the request is a logical and proper use and that the growth is there, whether we like it or not. Johnny Tucker, 42 Eleventh Street, reinforced what Mr. MacDonell said.. He added that the rule of the highest and best use of the land should apply; they should be able to develop the land in order to maximize the income in order to pay for the high price of the property. He said there are a great deal of people working on the base on a temporary basis and it would be convenient for them to have a motel close to the base, He felt the plan would cut down the traffic on Mayport Road because some people would be stopping at the motel/development rather than traveling the entire distance of Mayport Road. Commissioner Morris stated that it is refreshing to have something other than mini-warehouses or convenience stores take an interest in Mayport Road. Chuck. James stated that RG-2 would be agreeable for parcel B rather than RG-3. Be amended the request to RG-2 on parcel B. Guy Jennings stated that the request seems to be consistent with what the city wants in the area. Recognizing that the city is affected by some parts of the drainage in the area, Mr. Jennings motioned to recommend approval of the request for rezoning of parcel A to CG and parcel B to RG-2, contingent upon the recommendations of the City's engineers in regards to the drainage. Ron Gray abstained. * * J. * n * * * * * 7; * i. * n * J n Item #2 - Request for Rezoning - Vincent and Mary DeSalvo Mr. Robert Gittings, 1 Independent Drive, stated that he represented the petitioners. He stated that they wish to rezone the property on the northwest corner of Mayport Road and Levy Road to Commercial General for a Hardees Restaurant. He stated that they had been waiting for three months for the master plan of Mayport Road and that they wished to proceed with the rezoning process. He stated that the request is the same as the recommendations of the City of Jacksonville's Planning Department. He added that there is a need for a quick service restaurant on Mayport Road. There being no one else to speak for or against the request, Ruth Gregg motioned to recommend approval of the request for rezoning from ILW to CG. Ron Gray seconded the motion which carried unanimously. Item #3 - Review of Proposed Changes to Aquatic Gardens Mr. James Jaffa introduced himself and presented plans of the proposed changes to Aquatic Gardens subdivision. He stated that they were building the same basic house, but were separating the garage and making it an option, and rather than being of concrete construction, the units would be constructed of energy efficient wood frame. He added that they would have a two hour firewall as opposed to the original plans with a one hour firewall. Chairman McCaulie asked the reason for having garages as options. Mr. Jaffa replied that it was due to cost; a unit with a garage would be priced aproximately $7,000. more. Guy Jennings said he wasn't sure garages would add to the aesthetics of the subdivision, but thought they were good to have for storage. Ron Gray asked if Mr. Jaffa had clear title to the subdivision. Mr. Jaffa replied that Duval Federal has forclosed and taken the deed in lieu, He said there were details that they were in the process of settling. Ron Gray asked Mr. Jaffa if he would consider a provision requiring a certain number of units to have garages. Mr. Jaffa replied that it would be an economic restraint that could be devastating. He reminded the Board that Fairway Villas Subdivision was approved with garages as an option. Advisory Planning Board February 19, 1985 Page 4 Ruth Gregg asked if the subdivision would be fenced-in. Mr. Jaffa replied that it would probably have to be enclosed. Mrs. Gregg stated that there would have to be a back gate so the children could get to school without going onto Atlantic Boulevard. Mr. Jaffa stated that there is an open ditch there. Guy Jennings informed Mr. Jaffa that there are provisions for an access over the ditch. Mr. Jaffa replied that it's required at the option of the city and that Duval Federal holds a bond for the bridge, should the city desire that it be constructed. Mr. Jaffa felt that because the property is not under a PUD zoning, it was not a consideration of the Advisory Planning Board. Mr. Fellows stated that the Board has site plan review privileges as it relates to the subdivision's internal automotive activities, including offstreet parking. Guy Jennings reminded the Board that, under the present zoning, Mr. Jaffa could come in with a plan for an apartment complex with no garages. Ruth Gregg stated that the Board might as well let him do it. She motioned to recommend approval of the changes. Guy Jennings seconded the motion which carried. Jn Jn n OLD BUSINESS Rezoning - Mayport Road Corridor Commissioner Morris stated that the Advisory Planning Board had previously recommended adopting the proposed plan, but noting that CI would be eliminated in the entire city, the Board recommended that some CI uses be incorporated into other classifications. He stated that the Commission had referred it back to the Board for a more specific recommendation; to determine which CI uses should be incorporated into the other classifications. Mr. Bud Gross, Bud's Automotive, asked if he could sell his busines if it was determined to be a non-conforming use. Ron Gray stated that he would be grandfathered-in, and that he could sell it as long as the use is not discontinued for a period of six months or longer. Mr. Gross asked whether he could enlarge a non-conforming building. He was informed that he could not add onto or alter the building except as required by law. Herman Williams, 20 Donners Road, asked if it was the intent of the rezoning to do away with paint and body shops. Commissioner Morris assured him that it was not the intent to do away with paint and body shops. Willie Davis, 780 Bonita Road, who owns a grandfathered-in cabinet shop on Simmons Road, wanted to know if his property would be included in the commercial zoning district. It was determined that his property falls outside Advisory Planning Board February 19, 1985 Page 5 of the commercial zoning boundary line. Commissioner Morris asked why the line couldn't be moved to include Mr. Davis' property. Guy Jennings replied that the purpose of zoning is to implement a plan, it is not to accomodate people who have businesses in areas that perhaps you do not want a business. Ruth Gregg suggested that the Board members get out and walk Mayport Road before making any recamnendations. Ron Gray motioned that the Board hold a meeting for the purpose of viewing Mayport Road so that the Board could make an intelligent recommendation. Guy Jennings stated that the City of Jacksonville's professional land planners had performed a visual land use survey of the area. He asked why the Board is going to go out and second guess the experts. Chairman McCaulie stated that he thought the Board had been asked to look at the Commercial Intensive uses that should be incorporated into the other classifications. Ron Gray withdrew his motion. He then motioned that the Board hold a special workshop to ascertain which CI uses will be allocated to CG, CL, and ILW zoning classifications.
