Perry for authorisation to operate a Day *luteery and Kindergarten at 390 Mayport Road, wishes to report as fo1lowe s The premises designated as 390 Mayport Road exist on Lot 1, Block 29, Section M, and consists of a frame residence built in 1948, which has 1124 sq. ft. of living area; and a separate frame garage, 20 ft. x 31 ft. Access to these buildings is from a well travelled and maintained dirt roadway in W. 4th Street. A substantial woven wire fence encloses these buildings. Lot 3 of Block 29, mentioned in supplementary note of the Perrys ' , has no buildings upon it. The two lots form an "L" with 51 foot frontage on Mayport Road and 145 ft. frontage on W. 4th Street. The residence is connected to the City water system, but a septic tank serves sanitary needs as City sewerage does not exist in that area. Nearest business establishment is "Raymond's Lockers" at 270 Mayport Road - roughly 250 feet away. Nearest residence pest of Mayport Road is No. 75 W. 4th St. - 400 fw.4t distant. The nearest unit of Atlantic Gardens Apartments, across Mayport Road, is roughly 200 ft. distant. Nursery and Kindergarten activities are recognized as businesses in the City of Atlantic Beach, and are regularly licensed as such. Therefore, conversion of a nonconforming residence structure in a Business "A" Zone to a recognized business use is deemed a reason- able interpretation of the request under consideration. The Committee recommends, in view of the apparent adequacy of the promises under consideration for the proposed use thereof; and in view of the fast that the proposed new use would change the premises from a Soncontsrm- ing to a conforming status; that subject to a determination by the City Attorney that such action would dot constitute a violation of any of the limiting provisions of our Zoning Ordinance, the request of Mr. and Mrs. Perry should be granted. The committee further recommends that, prior to issuance of an occupational license for the Perrys to operate a Nursery and Kindergarten at the location herein specified, they shall have in their pomades a license to operate such institution as issued by the State of Florida lailfare Board; also adequate proof that -all requirements of the State Board of Health have been complied with.
