10-15-96 v MINUTES OF THE COMMUNITY DEVELOPMENT BOARD OF THE CITY OF ATLANTIC BEACH, FLORIDA October 15, 1996 7:00 P.M. CITY HALL PRESENT Don Wolfson Robert Frohwein Pat Pillmore Mary Walker Mark McGowan Buzzy Grunthal AND Alan Jensen, City Attorney George Worley, II, CD Director Pat Harris, Recording Secretary ABSENT Sharette Simpkins Chairman Don Wolfson called the meeting to order and asked for approval of the minutes from the meeting of September 17, 1996. Upon motion made and seconded the minutes were approved. NEW BUSINESS: I. Application for Variance filed by Michael and Victoria Smith to construct a screened enclosure that will encroach setback requirements at property known as 1885 Live Oak Lane. Michael Smith introduced himself to the board and stated he desired to construct a screened porch on the rear of his residence that would encroach the rear yard setback by 14 feet. He stated that his residence had been designed around large oak trees on the property and due to the low hanging nature of the trees he could not build the porch in another location. He presented the board with pictures of similar screened enclosures. After discussion, Mrs. Walker moved to deny the variance request. Mr. Frohwein seconded the motion and the variance was denied by a vote of 5 - 1 with Mrs. Pillmore voting nay. After further discussion regarding a possible alternative in the construction, Mrs. Fillmore moved to reconsider the board's decision to deny the variance. Mr. McGowan seconded the motion which passed unanimously and the applicant will present a revised application at the next regularly scheduled meeting. II. Application for Variance filed by Kent Enterprises, Inc., to reduce parking requirements and waive island requirement in parking lot for property located at 751 Atlantic Boulevard. John Kent of Kent Theatres introduced himself to the board and explained that he recently completed renovations of the building formerly known as Royal Palms Theatre, now known as the Atlantic 8 Theatres, increasing the number of theatres to eight but reducing the number of seats. Upon completion of the improvements the existing parking area was repaved and striped but landscaping and new parking spaces were not installed. Mr. Kent presented facts and figures regarding attendance, seating and parking. He stated a variance is being requested for the Atlantic 8 Theatre allowing one parking space for every eight seats, including required handicapped spaces which would total 130 parking spaces and that landscaped islands not be required in the landscaping design. Rick Beaver, Mrs. Rick Beaver and Mrs. J. McCaulie introduced themselves to the board and requested the board to deny the application based mainly on the landscaping requirements. After discussion regarding possible alternatives to the parking and landscaping designs and with the consent of the applicant, the board tabled the application until the next regularly scheduled meeting at which time the applicant will present a revised application, and drawing demonstrating compliance with the landscaping code and showing approximately 200 parking spaces. The board agreed to a special meeting to discuss proposed amendments to the Zoning Code on November 19, 1996 at 6:00 p.m. There being no further business to come before the board on motion duly made the meeting meeting was adjourned.
