03-21-90 v MINUTES OF THE COMMUNITY DEVELOPMENT BOARD OF THE CITY OF ATLANTIC BEACH, FLORIDA MARCH 21, 1990 7:00 P. M. CITY HALL PRESENT W. Nasser Azari Michael Brooks Mr. Howie called the meeting to order at 7:03 p. m. and asked for comments or corrections to the minutes of the meeting of February 20, 1990. There being none, Mrs. Gregg motioned to approve the minutes as presented. Mr. Wolfson seconded the motion which carried unanimously. " r * " " OLD BUSINESS A. DISCUSSION AND RECOMMENDATION ON CLARIFICATION OF PERMITTED USES OF SUBSTANDARD LOTS OF RECORD. City Attorney, Alan Jensen presented to the board an ordinance revising the definition and permitted uses of substandard lots of record. The board suggested that each townhouse be more clearly defined as a single family unit and "nonconforming lots" be changed to the singular. Chairman McCaulie requested that the Community Development Director review alternative methods of determining height of structures and report back to the board. After further discussion the board returned the ordinance to counsel for revisions. NEW BUSINESS A. APPLICATION FOR USE BY EXCEPTION BY NASSER S. AZARI. PART B OF CASTRO Y FERRER GRANT (NORTH WEST CORNER OF ATLANTIC BOULEVARD AND AQUATIC DRIVE. ) Mr. Azari requested permission to allow a used car lot and car rental agency in Commercial General zone by exception and a car wash which is a permitted use. The Vice-President of the Beaches Aquatic Pool, Allen Potter, along with the following residents, spoke against the application; Barbara Bonner, Jane Chambers, Jim Hawkes, Matthew Roderick and Dezmond Waters. They felt the use was not in keeping with the neighborhood and sited traffic congestion and aesthetics as major concerns. After further discussion, Mr. Wolfson motioned to recommend denial of the application for exception. He referenced Section 24-63. ( 4) of the Code of Ordinances and stated concerns for ingress and egress, parking, and lighting. He added that the proposed uses were not compatible or harmonious with the area and suggested Mayport Road as a more suitable location. Mrs. Gregg seconded the motion which carried by a five to one vote. Mr. Howie voted nay. B. APPLICATION FOR REAR YARD VARIANCE BY MR. AND MRS. MICHAEL BROOKS. LOT 5, BLOCK 10, SELVA MARINA UNIT 6. 1741 LIVE OAK LANE. Mr. Brooks requested permission to construct a screened porch enclosure with an 18' -O" rear yard. Mr. Brooks presented to the board signatures of the affected neighbors supporting the new addition. After a brief discussion, Mr. Wolfson motioned to grant the rear yard variance.
