07-20-88 v MINUTES OF THE COMMUNITY DEVELOPMENT BOARD OF THE CITY OF ATLANTIC BEACH, FLORIDA July 20, 1988 7:00 P. M. CITY HALL PRESENT: Samuel T. Howie, Acting Chairman W. Gipson Lawrence Ross Marcus Prom Charlie Clark Tom Brannen Admiral Joe Coleman Jerry Kilen Mark Kredell ABSENT: Louis B. MacDonell Mr. Howie called the meeting to order at 7:09 p. m. He announced that approval of the minutes of the June 21, 1988 meeting would be deferred to the next meeting. NEW BUSINESS A. APPLICATION FOR PAINTING AND REPAIR SERVICE AS A HOME OCCUPATION - J. E. GIPSON; LOT 1, BLOCK 23, ROYAL PALMS UNIT NO. I; 825 PLAZA Mr. Gipson stated that he has been self-employed for the past 10 years and that he once had a license to operate from his home but that he allowed it to expire in 1983. He added that there would be no storage of equipment, paint or repair supplies and that the only advertising would be through the mail. There being no objections, Mr. Bass motioned to recommend approval of the application. Mr. Tappin seconded the motion which carried unanimously. B. APPLICATION FOR SEPTIC TANK VARIANCE - LAWRENCE ROSS; 153 LEVY ROAD Mr. Ross stated that his property is 450' from Levy Road and that the Public Works Director determined that due to the minimum rise and fall required, connection was unfeasible. He added that he was connecting to City water and agreed to connect to City sewer when it became more practical. Ruth Gregg motioned to recommend approval in Mr. Ross' name, provided that he connect with sewer when it becomes available. Kathleen Russell seconded the motion which carried unanimously. C. APPLICATION FOR SEPTIC TANK VARIANCE - MARCUS PROM; LOT 1 BLOCK 209 SECTION H; BLOCK 216 SECTION H Mr. Prom stated that his property is 10 blocks from the nearest water and sewer connection and agreed to connect when it becomes readily available. When questioned who would pay for the connection when it becomes available, Mr. Prom indicated that the homeowner would be responsible for the cost. John Bass motioned to recommend approval of the application. Donald Tappin seconded the motion. The motion carried 5 to 1. Mr. Howie voted NO. D. CONSIDERATION OF ORDINANCE NO. 90-88-143 AMENDING COMMERCIAL LIMITED ZONING Mr. Mullis gave a brief history to the creation of the ordinance which adds permitted uses of CG to CL as exceptions. (The Board had previously denied an application to rezone from CL to CG and an application for use by exception for auto servicing for a Goodyear Tire Company at the M&L Center. ) Mr. Mullis thought that the City Commission felt that adding the CG uses to CL as exceptions was desirable because of the ability to set limitations and restrictions without opening the door to all CG uses. After discussion Ruth Gregg motioned to recommend the approval of the application. Mr. Howie seconded the motion which carried unanimously. E. RECONSIDERATION OF APPLICATION FOR USE BY EXCEPTION - FRED LEWIS; PART OF TRACT A, ROYAL PALMS, UNIT ONE; 1487 MAYPORT ROAD (Subject to passage of ordinance #90-88-148. ) There was no one present to represent the application. After a brief discussion Kathleen Russell motioned to recommmend approval of the application with the conditions set forth in the minutes of the City Commission meeting of June 27, 1988. Ruth Gregg seconded the motion which carried unanimously. F. APPICATION FOR REZONING/COMPREHENSIVE PLAN ADMENDENT - THE HASKELL COMPANY/FLEET LANDING, A PLANNED UNIT DEVELOPMENT Tom Brannen and Charlie Clark of the Haskell Company, and Admiral Joe Coleman, Chairman, Naval Continuing Life Care Foundation addressed the Board and gave a lenghthy discription of the project. The project includes: 1500 sq. ft manor homes, five apartment buildings, central dining facilities, a barber/beauty shop, an ice cream shop, a spa and exercise center and a nursing facility near Mayport Road. The entrance fee would be between $85- $250, 000 plus a monthly maintenance fee of $1, 400. There would be between 150 and 160 full time employees split between three shifts. They estimated that the traffic would be 40% as much as would be generated by a single family development. Board members and several members of the audience, including representatives of the North Duval Beaches Association and the Selva Norte Home Owner 's Association, expressed concern over the Selva Marina Drive entrance. Suggestions were made to limit traffic through the Selva Marina Drive gate to emergency vehicles and bicycle and pedestrian traffic. After further discussion Chairman McCaulie motioned to recommend approval of the development subject to 1 ) a maximum building height of three stories, and 2) the City Commission consider limiting, to emergency access, the entrance on Selva Marina Drive; with the developer and the homeowners attempting to resolve their differences regarding Selva Marina access. Ruth Gregg seconded the motion which carried unanimously. G. APPLICATION FOR USE BY EXCEPTION - SOUTHSIDE VACUUM/JERRY KILEN; 1221 MAYPORT ROAD (Subject to passage of Ordinance No. 90-88-143) Mr. Kilen stated that he is seeking an exception for sales and service of vacuums and limited furniture sales. He stated that there would be no outside storage of equipment or display of furniture. Mr. Tappin motioned to recommend approval of the application subject to there being no outside storage of material or display of furniture. Gregg McCaulie seconded the motion which carried unanimously. MISCELLANEOUS BUSINESS A. Mark Kredell presented the Board with a proposal to recombine Lots 17 and 18, Donner 's Replat No. 2. The Board was in general agreement with the concept and asked Mr. Kredell to proceed through the proper administrative channels.
