NEW BUSINESS
A. APPLICATION FOR HOME OCCUPATION BY EXCEPTION; 1985 BRISTA
DE MAR CIRCLE; GERALD C. R. WHEATLEY
Mr. Wheatley stated that he and his brother-in-law were starting
a construction company and that his home would be used only for
bookkeeping and receiving mail. He added that there would be no
employees or staff. Chairman McCaulie questioned where meetings
with potential clients would be held. He replied that meetings
would be held at realtors offices.
For information, Mrs. Russell informed the board that, at the
November 14th meeting of the City Commission, Commissioner
Edwards expressed concern for the increasing number of home
occupational licenses being granted.
Mr. MacDonell informed Mr. Wheatley that if the application was
granted it would be on the basis that there be no increase in
traffic, that there will be no storage on the property, and that
payment to subcontractors be made through the mail. He added
that a violation of the conditions could result in revocation of
the license.
There being no further discussion Mr. Bass motioned to recommend
approval of the application. Mr. Tappin seconded the motion.
B. APPLICATION FOR USE BY EXCEPTION; LOTS 1, 2, 3, & 4 BLOCK 238

C. APPLICATION FOR USE BY EXCEPTION FOR MINOR CONTRACTOR IN A
CG DISTRICT (GRANDFATHERED-IN RESIDENCE) 80 DORA STREET;
JOHNNY CROUCH;
Mr. Crouch stated that he was a handyman; painting, replacing
windows and doors and making minor repairs. Mr. Bass asked if
there would be any outside storage and Mr. Crouch replied that
there would be no outside storage. Chairman McCaulie asked what
other businesses were in the vicinity. Mr. Crouch replied that
his property is near the Atlantic East Animal Clinic.
There being no further discussion Mr. MacDonell motioned to
approve the application. Mr. Howie seconded the motion which
carried unanimously.
D. APPLICATION FOR SEPTIC TANK VARIANCE; LOT 3, BLOCK 208,
SECTION H, TULIP STREET; BY ALEXANDER T. HARRIS
Mr. Harris explained that he was not aware of the lack of sewer
facilities or the septic tank moratorium when he purchased the
property three years ago. Chairman McCaulie asked if Mr. Harris
would agree to pay for and connect to the public system when it
becomes available. Mr. Harris replied that he would.
There being no further discussion Mr. MacDonell motion to
recommend approval of the application. Mrs. Russell seconded the
motion which carried unanimously.
E. APPLICATION FOR REZONING FROM RS2 TO PUD & VARIANCE OF THE
AREA REQUIREMENT FOR PUD; LOTS 35, 37, 39, & 41, BLOCK 7;
ATLANTIC BEACH; BY STEVEN HARRIS
Steven Harris, 285 Broadway, New York, informed the board that he
and his partner had met with neighboring property owners on
November 13th to discuss the project. He stated that their main
concern was the proposed density. He gave a general description
of the project and compared allowed and proposed densities and
lot coverages.
Mr. MacDonell stated that he felt the application was improperly
before the Community Development Board; that it should go
directly to the City Commission. Mr. Harris replied that he had
consulted with the City Attorney and had been referred to the
Community Development Board. Upon being questioned by the board
the secretary stated that Mr. Mullis had suggested that if the
board questioned the matter they could refer it to him for an
opinion. After a lengthy discussion Mr. MacDonell motioned to
refer the matter to the City Attorney for an opinion. Mr. Tappin
seconded the motion which carried unanimously.
