09-15-87 v MINUTES OF THE COMMUNITY DEVELOPMENT BOARD CITY OF ATLANTIC BEACH, FLORIDA September 15, 1987 CITY HALL 7:00 P. M. PRESENT: W. Gregg McCaulie, Chairman Louis B. Fellow, City Manager Rene' Angers, Recording Secretary AND: Dylan Morgan Allan Wheeler Robert Callander James Steeg ABSENT: Samuel T. Howie Chairman McCaulie called the meeting to order at 7:03 p. m. He suggested that approval of the minutes of the meeting of August 18, 1987 be deferred until the next meeting to give ample time for review. Mr. Tappin motioned for deferral of the minutes. Ruth Gregg seconded the motion which carried unanimously. NEW BUSINESS A. Application for Rear and Side Yard Variance; Lots 753, 754, 755 except the east 4' of Lot 755; and Lot 772 except the west 3' of Lot 772, Saltair Section I : 675 Atlantic Boulevard, by Thomas J. Bennett Mr. Bennett was not present to discuss his application. Mr. MacDonell stated that the item had been presented at their last meeting but action had been deferred until rezoning of the property could be completed. He felt that it was not necessary to discuss it further. Mr. MacDonell motioned for approval of the application. Ruth Gregg seconded the motion which carried unanimously. B. Application for Rear Yard Variance; Part of Lot 3, Section 9, Township 2 South, Range 29 East; Beach Avenue: by William N. Morgan and Homer H. Humphries Dylan Morgan, 1653 Coquina Place, represented the applicants in the request for variance. He presented the Board with two site plans; one indicating the present building area, and one indicating the proposed building area. He stated that the property is 121. 84' wide and contains 6, 092 square feet of area, and that the rear setback variance was needed due to the 50' depth of the property. He added that the property was acquired in the fall of 1986, prior to annexation. Pete Dowling inquired as to whether they planned to build a duplex or a single family dwelling on the property. Mr. Morgan replied that they were presently undecided. Mark Kredell stated that he empathize with the applicants, that he was denied a variance on his 50' x 50' property. Other members of the audience expressed concern over increased traffic and setting a precedent. Mr. MacDonell felt that there was considerable cause to grant the variance in that the City of Jacksonville would have allowed a 10' rear yard when the property was purchased. He suggested treating the property as a corner lot ; 20' on the north and south, 15' on Beach Avenue, 5' on the interior side opposite Beach Avenue. This was agreeable with the applicants, although they asked for a little leeway in that the structure had not yet been designed. Mr. MacDonell motioned to approve the application with the intent that the property fit the mold of a corner lot ; a 20' yard on the north, 15' yard on the south, 10' yard on the west, and 15' yard on Beach Avenue. Mr. Bass seconded the motion. The Chairman addressed the findings of fact. The Board generally agreed that all criteria was met. The vote was called. The motion carried unanimously. C. Application for Side Yard Variance; Lot 7, Block 38, Section H; by Allan S. Wheeler and Robert J. Callander Allan Wheeler, 1321 Penman Road, stated that they proposed to construct an office with warehouse space on the lot and that they were requesting a setback variance to allow a 5' yard on the east side and a 10' yard on the west side. This will enable them to drive-thru the building and pull out on the west side. He added that this would also keep them further away from the duplex next door. Marvin Butler, 4478 Packard Drive, stated that he owns a tree service and that he had been asked by the residents in the area to attend the meeting. He stated that there is a 20" sycamore tree on the southeast corner of the lot and that it is the only shade tree in the area. He added that the tree is approximately twenty years old and that the residents want it preserved. Sissy Keller of Eighth Street also asked that the tree be preserved. The Board questioned whether it was necessary to remove the tree. Mr. Wheeler replied that it sits in the corner of the proposed foundation. There being no further discussion, Chairman McCaulie motioned for approval of the application. Mr. MacDonell seconded the motion which carried 5 to 1, Mr. Bass voted no. D. Request for Rezoning by Contiguous Property Owners; Two Parcels in North Atlantic Beach-Seminole Beach Julie Anderson, 1655 Beach Avenue, stated that she represented the North Duval Beaches Association. She stated that the property owners in the area want to be protected from over development and that down-zoning of the area has been "in the works" for a year. George Bull, Jr. suggested that the property owners deed-restrict their property against multi-family development rather than ask the city for rezoning. Chairman McCaulie stated that the surrounding property owners within 300' of the subject areas had not been notified of the public hearing. He motioned to defer action until they were notified. Mr. Tappin seconded the motion which carried unanimously. The Chairman asked Ms. Anderson to supply the names and mailing addresses of the owners within 300' so that they could be notified prior to the public hearing. * * * * * MISCELLANEOUS BUSINESS A. Request for Variance of the Septic Tank Moratorium by James Steeg for Property on Stewart Street Mr. Steeg stated that they proposed to build a warehouse on Stewart Street for their plumbing company. He indicated that they were presently operating from his parents home on Tenth Street under a grandfathered status. He stated that the sewer is 8' deep in that area and that it would cost $15, 000. 00 to run it 190' to his property. Mr. MacDonell motioned to recommend approval of the request subject to connecting to city sewer when it becomes available. Mr. Bass seconded the motion which carried unanimously. * * * * * Allan Almada asked the Board about possibly acquiring additional beach accesses in the Twentieth Street area. The Board informed Mr. Almada of the condemnation proceedings and pending litigation at Twentieth and Seventeenth Streets and of the seminar on the future of beach access co-sponsored by the City of Atlantic Beach to be held at the Sea Turtle on October 1st and 2nd. * * * * * There being no further business before the Board, the meeting was adjourned at 8:05 p. m. r- e g d cke, Chairman
