There being no corrections or comments to be made to the minutes of the meeting of August 21, 1984, Ron Gray motioned that they be approved as presented. Guy Jennings seconded the motion. Chairman McCaulie declared them approved as presented. ;; ;; ;; * ;: ;; ;; ;; NEW BUSINESS Item #1 - Request for rezoning of a 29 . 5 acre tract of land bounded by Eleventh Street , Plaza , Royal Palms Unit I , and the lagoon; from Open Rural and Residential General-2 to a Planned Unit Development ; submitted by Reyhani Construction, Inc. , and Grenville and Meuse Construction Company . Guy Jennings declared a conflict of interest and stated that he would abstain from voting . Richard Prosser , BHR Planning Group , 2000 Corporate Square, stated that he represented the applicants in the rezoning request. Mr. Prosser stated that they wished to rezone the property for the purpose of 170 townhouse units ; 85 buildings . He stated that the project would have 16% ground coverage , well below the allowable 35%. He stated that the density would be between 5 and 6 units per acre, each unit having aproximately 1 , 100 square feet of living area and a two car garage. He stated that they would be within a middle income price range ,approximately $70-$100 ,000 . 00 per unit . Advisory Planning Board December 4, 1984 Page 2 Mr. Prosser added that the development would be constructed in four phases . Chairman McCaulie opened the floor for discussion from the audience. Henry Gartland, 1140 Seminole Road, asked if the developers would also be clearing the land in phases . Phil Grenville replied that it would not be cost effective to clear the entire property at once and that it would be done in phases . Mr. Prosser added that the units would not be visible from the lagoon, that there would be at least 150 ' of dense vegitation that would remain as a buffer along the lagoon. Residents expressed concern that the storm water retention areas remain in their natural state as much as possible , noting the existing wildlife in the area. Ed Ras , 1090 Seminole Road, asked what was planned for the recreation area. Mr. Prosser replied that it would be passive recreation and that they may have a pool or a tennis court on the east side of the project . Steve Fouraker, 387 Sixth Street , asked whether the land had been zoned Open Rural in order to encourage a Planned Unit Development or to maintain its OR status , Mr , Moss stated that it was intended to encourage a P . U. D. Commissioner Morris asked if the applicants were committing to a two car garage and 1 , 100 square feet per unit . Mr . Prosser stated that each unit would have a two car garage and that they planned to have 1 , 100 square feet per unit , but they would rather commit to 1 , 000 square feet per unit . Commissioner Morris suggested a compromise of 1 , 050 square feet per unit . Ed Ras asked what method in ingress would be used for construction purposes , stating that he did not want dump trucks using Eleventh Street for the next five years . He suggested that another route be used, possibly the westerly easement . Mr. Moss asked if this project would have covenants and restrictions similar to those in Selva Marina Unit #3 , directly across the lagoon. Mr . Prosser stated that they would have covenants and restrictions and that they would probably be more restrictive than those in Selva Marina Unit #3 . Advisory Planning Board December 4, 1984 Page 3 Ruth Gregg expressed concern for the traffic problems on Plaza. She was also concerned about having a swimming pool in the development , noting how noisy they are. Mr. Moss asked the proposed completion time for the development . Phil Grenville replied that they would like five years for completion time and asked that the City take into consideration the existing sewer moratorium, and stated that they may not be able to begin construction for two years due to the moritorium. Ron Gray motioned to recommend approval of the rezoning request subject to the following provisions ; 1. ) That the storm water retention area remain, as much as possible , in its present natural state . 2 . ) That the minimum square footage of the units be 1 ,050 sq. ft. and that each unit provide a two car garage . 3. ) That during construction the developer attempt to have construction vehicles access the property from other than Eleventh Street . 4. ) That the covenants and restrictions address the use of the lagoon and that they be similar to those which exist in Selva Marina Unit #3 , directly across the lagoon. 5 . ) That the time limit for the completion of the development be five years from the passage of the ordinance, with the consideration that the developers may be constrained by the existing sewer moritorium. 6 . ) That the road on the westerly boundary of the property be designated as a public right-of-way rather than an easement . Chairman McCaulie seconded the motion. The motion carried, Ruth Gregg and Ron Gray voted in favor of the request , Gregg McCaulie voted against the request and Guy Jennings abstained from voting . �� * * i'- * A -A- Item Item #2 - Request for rezoning of approximately 8 . 5 acres along the northerly city limit line between Seminole Road and Selva Marina Drive (extended) ; from Open Rural to RS-1 (Residential-Single Family) ; submitted by Selva Developers , Inc . Doug Miller , England-Thims & Miller , 4800 Beach Boulevard, stated that he represented the developer . He stated that they proposed a residential community that exceeds the Advisory Planning Board December 4, 1984 Page 4 requirements of RS-1 zoning and that is compatible with Selva Norte and Selva Marina Gardens Subdivisions . He stated that the developers were simultaneously applying for rezoning for the remainder of the project , north of the Atlantic Beach city limits , with the City of Jacksonville . Mr . Miller stated that there would be approximately 275 units in the entire project and that approximately 12 lots would be partially or completely in the City of Atlantic Beach. He stated that the density would be approximately 2 . 5 units per acre . He added that there would be a natural buffer adjacent to Selva Marina Gardens and Selva Norte, and that there would be a 200 ' natural buffer along Seminole Road. He stated that the development would be constructed in 3 - 100 lot phases over a 3-5 year period. He added that the minimum lot size would be 80 ' x 102 ' ; the majority being 100 ' x 150 ' . He stated that this would be a very high income development . Guy Jennings reminded the Board of a previous proposal to have approximately 800 units on the same property . Commissioner Morris asked if the lakes were existing. Doug Miller replied that they would have to be created in order to satisfy the drainage requirements of the St. Johns Water Management District . Mr. Miller stated that the City of Atlantic Beach would have no maintenance responsibilities as the streets would all be located in the City of Jacksonville . Mr. Moss stated that it should be determined how fire and police protection and garbage pick up would be provided, and noted that in some cases one half of a house would be in the City of Atlantic Beach and one half in the City of Jacksonville. Mr. Miller suggested that the City Attorney be consulted. Guy Jennings asked for the projected market value. Mr. Miller replied that the lots would be priced between $30 ,000 . and $35 , 000. and that the houses would probably be priced from $125 ,000 . and up . Connie Miller, 430 Garden Lane , expressed concern about the traffic on Seminole Road. She was also concerned about the safety of the lakes to the area children and stated that she didn' t think they were necessary . Doug Miller replied that the lakes are a regulatory requirement and that they would be built according to the Federal Housing Administration's guidelines for lakes in residential areas . Advisory Planning Board December 4, 1984 Page 5 Steve Fouraker asked if there would be a tree preservation policy in the development . Mr. Miller replied that in addition to the natural buffers there would be covenants and restrictions addressing tree preservation, similar to those in Selva Norte. Guy Jennings motioned to recommend approval of the request. Ron Gray seconded the motion which carried unanimously. v. J. * :: :: :: :: :: * i* J' :: :: * Item #3 - Request for "Use by Exception" for on premises consumption of beer and wine at Rosario ' s Pizza; submitted by Rosario Recupito . Carol McClelland of Candler Development Corporation stated that the applicants are the same people that own Capriccio ' s Restaurant and that under a seperate corporate name they would like to open a pizza and deli-sandwich type restaurant . She stated that it would be mostly take-out orders and that the beer and wine would be for those eating in the restaurant . Guy Jennings motioned to recommend approval of the use by exception. Ruth Gregg seconded the motion which carried unanimously. J. J. .V .. J. ._ J. J. J. .L J. n n n n i♦ i♦ n n n i♦ n n n i♦ i♦ n i♦ n Item #4 - Policy Determination; Paving of Public Right-of-Way Ruth Gregg stated that she was totally against the paving of public right-of-way and suggested that it be made into an ordinance. Mr. Moss stated that no one has the right to do anything on public right-of-way without approval and wasn ' t sure if an ordinance was necessary. Guy Jennings asked the procedure used by the State for paving public right-of-way. Doug Miller replied that to do any work in any state right-of-way you must first obtain a right-of-way permit , approved construction plans , a permit to construct , and a bond. Gregg McCaulie stated that it should be prescribed in an ordinance what can and cannot be done on public right-of-ways . He added that he ' d rather be "safe than sorry" in passing an Advisory Planning Board December 4, 1984 Page 6 ordinance that is not actually necessary. Ron Gray motioned to recommend that an ordinance be passed requiring permits for the use of public right-of-way and that it be the general policy to deny indiscriminate paving of the public right-of-way. The Board members unanimously agreed to the recommendation. is is j_. n is J: * 4 J. is is * iC MISCELLANEOUS BUSINESS Reconsideration of "Use by Exception" - Sunrise Community Evangelical Free Church Mr. Moss stated that the church had planned to ask the Board to reconsider the use by exception that was granted them subject to Cornell Lane being used for access to the property .
