12-15-87 v MINUTES OF THE COMMUNITY DEVELOPMENT BOARD CITY OF ATLANTIC BEACH, FLORIDA December 15, 1987 CITY HALL 7:00 P. M. PRESENT: Louis B. MacDonell, Vice Chairman Samuel T. Howie Donald Tappin Ruth Gregg Frank Delaney AND: Claude L. Mullis, City Attorney Richard C. Fellows, City Manager Rene' Angers, Recording Secretary AND: Gerard Vermey Mr. and Mrs. Guy Johnson Robert Dawkins Mable D. Bass ABSENT: W. Gregg McCaulie, Chairman John Bass The meeting was called to order at 7:00 p. m. by Vice Chairman MacDonell. He asked for comments on the minutes of the meeting of November 17, 1987. There being none, Mr. Tappin motioned that they be approved as presented. Mr. Delaney seconded the motion which carried unanimously. * * * * * NEW BUSINESS A. Application for Side Yard Variance; 1875 Beach Avenue, Lot 41, North Atlantic Beach Unit II by Dr. and Mrs. Don Smith Gerard Vermey, 65 Shell Street, Atlantic Beach, stated that he was the Smith's architect. He stated that he had designed a 1365 square foot addition to the front of the Smith 's house that extends the existing exterior walls. He added that the addition will not encroach any further than the current structure. He stated that the zoning requires 15' total side yards and that they were proposing total side yards of 11 ' (5' on the north and 6' on the south) . The south yard is adjacent to a public beach access. The following people expressed their approval of the variance: Mark Kredell-1851 Beach Avenue, Lisa Pelkey-1887 Beach Avenue; Steve Landon-1785 Beach Avenue. No one spoke in opposition. Vice Chairman MacDonell closed the public hearing and addressed the findings of fact. After discussion Mr. Howie motioned to approve the application. Mrs. Gregg seconded the motion which carried unanimously. B. Application for Rear Yard Variance; Lot 19, Beachside Subdivision by G. Guy and Carol A. Johnson Mr. Johnson, 417 Ocean Boulevard, Atlantic Beach, stated that their house had been specifically designed to fit on this lot in accordance with the City of Jacksonville's specifications; 10' rear yard. He stated that they had spent a considerable amount in architectural and design fees. Mr. Johnson stated that their lot is adjacent to undeveloped lots and that the Beachside developers had no objection to the variance. He added that a similar variance had been issued to Sandy Seminak who was in the same predicament. The Board addressed the findings of fact. The Vice Chairman felt that the Johnson's were victims of hardship by virtue of the change in the rear yard provision and having proceeded based on the contracts and agreements previously given them. Ruth Gregg motioned to approve the application. Mr. Tappin seconded the motion which carried unanimously. C. Application for a Home Occupation by Exception; 1451 Beach Avenue, Lot 8, Block 61, Atlantic Beach Subdivision A, by Thomas J. Aycock Robert Dawkins, stated that he was representing Mr. Aycock as his attorney. He stated that Mr. Aycock is presently using a bedroom as his office but to keep his brokerage license valid he needs a business office. He stated that the office would be for Mr. Aycock 's own personal investments and that there will be no employees or traffic. Vice Chairman MacDonell suggested setting a one year time limit on the exception. Mr. Howie didn't think Mr. Aycock should be given relief from the expense other brokers endure. Mr. Delaney motioned to recommend approval of the application with the stipulation that there be no increase in traffic, and that the exception be issued to Mr. Aycock exclusively. Vice Chairman MacDonell asked Mr. Delaney to consider placing a time limit on the exception. Mr. Delaney amended his motion to include a one year time limit. Ruth Gregg seconded the motion which carried four to one. Mr. Howie voted no. D. Application for Home Occupation by Exception; 715 Redfin Drive, Lot 3, Block 8, Royal Palms Unit II, by Mable D. Bass Mrs. Bass stated that she planned to have a strictly mail-order business in her home, that there would be no employees, no telephone, and no customers at her home. She would work from a desk in her den. After a brief discussion Ruth Gregg motioned to recommend approval of the application. Mr. Delaney seconded the motion which carried unanimously. Miscellaneous Business A. The Board reviewed a request by Herbert B. Moller, Jr. for a one year extension on a rear yard variance granted him on April 21, 1987. After discussion Mr. Howie motioned to grant Mr. Moller a one year extension. Mr. Delaney seconded the motion which carried unanimously. * * * * * There being no further business before the Board Vice Chairman MacDonell declared the meeting adjourned at 7:27 p. m. Louis B.
