03-19-85 v MINUTES OF THE ADVISORY PLANNING BOARD CITY OF ATLANTIC BEACH, FLORIDA March 19, 1985 City Hall 7:00 P.M. PRESENT: W. Gregg McCaulie, Chairman Mrs. Ruth Gregg Guy M. Jennings Ron D. Morris, Jr. Chairman McCaulie called the meeting to order at 7:15 p.m. He asked if there were any comments or corrections to be made to the minutes of the meeting of February 19, 1985. Ron Gray motioned that the minutes be approved as presented. Guy Jennings seconded the motion which carried unanimously. Chairman McCaulie called the Board's attention to the first item on the agenda. J, J. * * * * * * * * * J. J, J. J. J, J. * Item #1 - Reconsideration of Use by Exception Permit; Sunrise Community Evangelical Free Church Gary Christian, 1018 Main Street, Atlantic Beach, stated that he was an attorney representing Sunrise Community Evangelical Free Church. He stated that the use by exception was granted contingent upon the extension of Cornell Lane and that Cornell Lane be used for access. He stated that they were negotiating with Jimmy Jaffa of Aquatic Gardens and John Lauwert of the Beaches Aquatic Pool, and that they both agree with the proposed access. Mr. Christian stated that they were requesting the City to allow Sunrise Church to use the revised access route in lieu of the extension of Cornell Lane, and to allow the release of the letter of credit for the extension of Cornell Lane when the access route is completed. The City Manager stated that the easement would have to be accepted by the City Commission and dedicated to the City. He added that the zoning code provides that no building permit will be issued for any structure that does not abut on a public street or easement, dedicated and accepted by the City Commission. Advisory Planning Board March 19, 1985 Page 2 Guy Jennings asked who would be responsible for maintaining the easement. Mr. Christian replied that the Church would enter into a maintenance agreement in connection with the execution of the easement agreement. After a brief discussion Ron Gray motioned to recommend approval of the request as presented, subject to the provisions of the zoning code and the granting of the easements. Guy Jennings seconded the motion which carried unanimously. Item #2 - Rezoning of Mayport Road Corridor The City Manager informed the Board that massive changes in the zoning code, such as deleting and adding zoning classifications, would require an amendment to the Comprehensive Plan which would be a lengthy process. Ron Gray asked if spot rezoning, in accordance with the City's plans for Mayport Road, would be permitted during that interim period. Commissioner Van Ness stated that the Department of Community Affairs would have to be consulted. The secretary presented the Board with a color-coded zoning map, reflecting the decisions made at the workshop meeting of March 12th. The Board decided that the RNH zoning should be deleted because it is not appropriate or compatible with the area. The CG zoning would be extended to Atlantic Boulevard. The westerly portion of the RMH zoning would be included in the RG1 district. The Board also decided to eliminate the 'jogs' in zoning in the CG area from Donners Road to Church Road, to make an even line. They felt it would give enough depth for development. Guy Jennings was concerned that by having the CPO zoning three lots deep, we may end up with offices on Saratoga Circle and Forrestal Circle rather than on Mayport Road. The Board felt that one lot would not be deep enough to develop. They decided that it should be two lots deep. The Board also felt that there should be a buffer of CPO north of Forrestal Circle. It was determined that it would be the same depth and 104 feet wide. Ron Gray motioned to recommend to the City Commission, approval of the zoning changes as presented on the color-coded zoning map. Chairman McCaulie seconded the motion which carried unanimously. Advisory Planning Board March 19, 1985 Page 3 Ron Gray motioned to recommend to the City Commission that CI zoning be eliminated and that some of the uses in CI be allocated to CG, CL, and ILW, as per the Board's recommendations. Chairman McCaulie seconded the motion which carried unanimous ly. Ron Gray motioned to recommend to the City Commission, the creation of a new zoning classification, CPO, Commercial Professional Offices, which would permit offices but no sales or manufacturing. Permitted uses would include, but would not be limited to, offices of attorneys, real estate agents, physicians and dentists. Chairman McCaulie seconded the motion. The motion carried unanimously. Ron Gray motioned that, should the City Commission concur with the recommendations of the Advisory Planning Board, the City Commission instruct the Board as to whether they will entertain spot rezoning that is in accordance with the overall plan for Mayport Road, during the interim period until the plan is approved. Chairman McCaulie seconded the motion which carried unanimously. Guy Jennings asked about the second major artery west of Mayport Road as discussed at the workshop. Ruth Gregg stated that the new Navy housing projects had blocked the direct route. Guy Jennings felt that the area on the west side of Mayport Road could become a problem area. He motioned to recommend to the City Commission that a comprehensive plan be made for Section H, and that the City of Jacksonville be asked to give assistance. Chairman. McCaulie seconded the notion which carried unanimoulsy. Definition of Lot Coverage Guy Jennings stated that not including parking, swimming pools, walks, etc, , in the definition of lot coverage was a good idea. He was concerned, however, that there should be some provision to prohibit people from paving large portions of their lots.. The Board asked the secretary to investigate the requirements of other cities and report back to the Board at the next meeting. These districts are intended for high intensive sales and services which require a conspicuous and accessible location with direct access to highways. These uses are generally more intensive than CL and CG uses and require ample off-street parking and loading. (2) Permitted Uses (a) Retail outlets for sale of general merchandise, including new or used automobiles, trucks and tractors, mobile homes, boats, vehicle parts (but not wrecking yards, storage yards, junk yards or scrap processing yards) , heavy machinery and equipment, plant nursery, lumber and building supplies and similar products. (b) Service establishments of all kinds including automotive service station or truck stop repair and service garage, ammdsemmment-park, eireis, wholesale establishments, produce markets,-steam-laundry, contractors yard and similar uses. (c) Hotel and motel (d) Restaurant (nrchmr i-drive-rr)--- (e) Bar and lounge (f) Theater (g) Government buildings and facilities CI zoning classification has been deleted. Those uses that have been STRBCK-fHR9U II have been deleted as uses. The remaining uses are already in other zoning classifications or have been incorporated into other classifications. These districts are intended to provide general retail sales and services for the city as a whole. These districts should have direct access to major thoroughfares and are well suited for development of community shopping centers. (2) Permitted Uses (a) Retail outlets for sale of food and drugs, wearing apparel, toys, sundries and notions, books and stationery, luggage, jewelry, art, cameras, photographic supplies, sporting goods, hobby shops and pet shops (not animal kennel or veterinarian) , bakery (but not wholesale bakery) , home furnishings and appliances, office equipment and furniture, hardware, lumber and building materials, auto parts, and similar uses. (b) Service establishments such as barber or beauty shop, shoe repair, restaurant, gymnasium, laundry or dry cleaner, funeral home, job printing, radio and television repair. (c) Banks, loan companies, mortgage brokers, stockbrokers, and similar financial institutions. (d) Business and professional offices (e) Hotels and motels (f) Retail plant nursery (g) Retail sale of beer and wine (h) Auto service station {met-repair) maintenance and minor repairs, car wash (i) Theater (j) Government Buildings and facilities (k) Produce markets (no outside sales) (1) Those uses permitted in Commercial Limited zoning. (2) Permitted Uses (a) Service establishments such as barber or beauty shop, shoe repair, loundry or dry cleaning puck-up, tailer or dressmaker (b) Art gallery, library, museum (c) Medical and dental offices (but not clinic or hospital) (d) Professional offices such as accountant, architect, attorney, engineer, optometrist and similar uses. (e) Business offices such as real estate broker, insurance agent, manufacturing agent and similar uses. These districts are intended for light manufacturing, storage and warehousing, processing or fabrication of non-objectionable products, not involving the use of materials, processes or machinery likely to cause undesirable effects upon nearby or adjacent residential or commercial activities related to the character of the district and supporting its activities are permitted. (2) Permitted Uses (a) Wholesaling, warehousing, mini warehouses, storage or distribution establishments and similar uses. (b) Light manufacturing, processing (including food processing, but not a slaughter house) , packaging, or fabricating in completely enclosed building. (c) Bulk storage yards, not including bulk storage of flammable liquids. (d) Outdoor storage yards and lots (provi (ding front yards and 6' fence and excluding junk yards) , contractors yards. (e) Establishments for sale and repair of new and used automobiles, motorcycles, trucks and tractors, boats, automotive vehicle parts and accessories (except junk yards) , heavy machinery and equipment, farm equipment, lumber and building supplies, mobile homes, monuments and similar uses. (f) Heating and air conditioning, welding, sheet metal works, plumbing and electrical sales, laundries and dry cleaning, bakeries, bottling plants and similar uses.
