05-20-86 v MINUTES OF THE ADVISORY PLANNING BOARD CITY OF ATLANTIC BEACH MAY 20, 1986 CITY HALL 7:00 P.M. Present : Ron Gray, Acting Chairman Guy Jennings Ruth Gregg Candace Nordan And: Richard C. Fellows, City Manager Hilary Thompson, Recording Secretary And: F. Reuben Bennett, Sr. Rolando Delgado George Prom/Marcus Prom Mr. and Mrs. Dalgey Tim Shea/Bill Gellatly Absent: W. Gregg McCaulie Acting Chairman Ron Gray called the meeting to order at 7:03 p.m. He asked for any corrections to the minutes of April 15, 1986. There being no changes, Guy Jennings made a motion to accept the minutes as written, Ruth Gregg seconded the motion. The motion passed unanimously. * * * * * * * * * * * * * * * * * * * * * * * * * * NEW BUSINESS A. Request for Use By Exception by F, Reuben Bennett, Sr, ; Lot 3, Block 39, Section H; 38 West Ninth Street, Atlantic Beach. Currently zoned Commercial General. Application should be amended to request specific Use By Exception of Auto/Truck Service Garage. Mr. Bennett originally applied for a blanket Use By Exception, After considerable debate the Board told Mr. Bennett that they had a problem with him requesting a blanket exception. Mr. Bennett stated that he had several tenants in mind with specific businesses and asked if the application could be amended to request specific Use By Exception of Auto/Truck Service Garage. The Board accepted his amendment and Guy Jenning made a motion to approve the request with the following provisions: 1) No repairs are to be performed outside of the building. 2) No outside storage. 3) No manufacturing of any type is to be performed at this location. 4) A buffering fence is required to shield the area. Ruth Gregg seconded the motion which passed unanimously. B. Request for Use By Exception by Rolando Delgado; Lot 1, Block 233, Section H; 1399 Violet Street, Atlantic Beach. Currently zoned RG1A. Mr. Delgado explained to the Board that he wished to have a Use By Exception for a home occupation (Gardening Business) . Mr. Delgado explained that he stores no materials or equipment on the premises and uses his home only for doing paperwork and telephoning, The Board stressed that there could be no storage on the premises. Guy Jennings made a motion to approve the Advisory Planning Board May 20, 1986 Page 2 Use By Exception for Home Occupation, Ron Gray seconded the motion which passed unanimously. C. Request for Rezoning by George Prom; 38-25-29E, USD3, B De Castro Y Ferrar Grant, Currently zoned RG2. Request zoning RG3. Marcus Prom addressed the Board and showed them plans for the proposed development. Tim Shea property owner stated that he was in favor of the development because of the quality of the units planned. L.B. MacDonell expressed that he had no objections to the rezoning and suggested that Cornell Lane be extended to make a thru street to help with traffic flow. Mr. Bonhotel also spoke in favor of the rezoning. There was considerable discussion over the density of the development and problems with ingress and egress because of the location. Guy Jennings made a motion to approve the rezoning with the following stipulations: 1) Board recommends that in exchange for the increase in density Mr. Prom limit all units- to two (2) bedrooms. 2) Minimum unit size to be no less than 1,000 sq.ft. and have enclosed garages. 3) Development should employ full time gardener/ maintenance person. Ruth Gregg seconded the motion which passed unanimously. D. Public Hearing on proposed Special Use District for blocks 111,117,118, 119,139,140,141,142 and 143. Mr. Fellows addressed the Board and informed them that block 112 and 113 should be added to the Special Use District description. Mr. Dagley told the Board that this was the first time he had been informed of several of the items in the ordinance, He was in total objection to the fact that he would not be able to sell a single piece of land without losing the whole Special Use District Exception. Mrs. Nordan recommended that the wording be changed to reflect that only that piece of property being sold would lose the exception. Mr. Dagley also told the Board that it was impractical and toocostly to have to install fencing arould all properties involved, Guy Jennings made a motion approve the Special Use District with the following changes: 1) Section D, item 1 should include blocks 112 and 113. 2) eliminate section G, item 1, Section G, item 2 should become item 1 and changed to read; If any lot or parcel within the blocks herein referred, cease to be used for the purposes specified herein, then and in that case that particular lot or parcel shall not again be allowed the Special Use Exception and the autos, boats, parts, etc. removed at the owner's expense within six months after receiving written notice from the City of Atlantic Beach. Ron Gray seconded the motion. All members present voted in favor of the motion except Candace Nordan who was opposed, MISCELLANEOUS E. Concept Plan Submittal for the Mealy Street Properties, An Industrial development in the ILW district off of Stewart Street and Mealy Road. Tim Shea and Bill Gellatly presented the project to the Board. They are proposing the install water and sewer and pave roadways. Parcels would be sold in one (1) acre lots. The Board expressed concern over ingress and egress to the area. At present access would have to be from Levy Road to Main Street to Stewart Street to Mealy Road. The Board recommended that a roadway be constructed in the 60 foot right of way that belongs to the public and that would give direct access from Levy Road to the lower cul-de-sac at the south end of the project, Guy Jenning made a motion to recommend the Advisory Planning Board May 20, 1986 Page 3 Concept Plan for approval, Ruth Gregg seconded the motion which passed unanimously. * * * * * * * * * * * * * * * * * * * * * * * * There being no further business Candace Nordan motioned to adjourn the meeting, Guy Jennings seconded the motion.
