10-21-86 v MINUTES OF THE ADVISORY PLANNING BOARD CITY OF ATLANTIC BEACH, FLORIDA October 21, 1986 CITY HALL 7:00 P. M. Present : Ron D. Gray, Acting Chairman Ruth Gregg Candace Nordan And : Rene' Angers, Secretary And: Arthur M. Desroches Roger Joseph Marcus Prom Bobby Sturgen Absent : W. Gregg McCaulie Guy M. Jennings The meeting was called to order at 7: 17 p. m. by Acting Chairman Ron Gray. He asked for a motion on the minutes of the meeting of August 19, 1986. Ruth Gregg motioned that they be approved as presented. Candace Nordan seconded the motion which carried unanimously. NEW BUSINESS A. Request for Use by Exception - Arthur M. Desroches Mr. Desroches stated that he was requesting a use by exception for a home occupation at 1280 Tulip Street. Mr. Desroches is a minor contractor, building decks and gazebos. He stated that he would use the house for his office and that there would be no materials or supplies stored on the property. After a brief discussion, Ruth Gregg motioned to recommend approval of the request, subject to no outside storage being permitted. Candace Nordan seconded the motion which carried unanimously. B. Request for Use by Exception - Roger Joseph Mr. Joseph stated that his home building company had just completed construction of an office building at 462-468 Sturdivant Avenue and that he was requesting a use by exception in order to have his office there. He stated that he would keep his main office in Jacksonville and that this would be used for the convenience of meeting architects, realtors, and clients. Ruth Gregg motioned to recommend approval of the request, subject to no commercial trucks being permitted. Ron Gray seconded the motion which carried unanimously. C. Request for Use by Exception - Marcus Prom Mr. Prom stated that he was requesting a Use by Exception for a home occupation for his real estate office, contractors office, and a model home to be used for show, at 1398 Main Street. He stated that he has been using it as an office for the past three years so there would be no increased traffic. Clair McBride, 1285 Camelia Street and Val Wilcox, 750 West Fourteenth Street spoke in opposition of the request. It was determined by the Board that Mr. Prom did not live at the home, and therefore, could not have a home occupation. Mr. Prom, after discussion, withdrew his request for the real estate office and stated that he would move into the house if the Board would recommend approval of the use by exception. The Board suggested that Mr. Prom amend and re-submit his application. Ruth Gregg motioned to recommend denial of the request. Candace Nordan seconded the motion which carried unanimously. * * * * * D. Request for Use by Exception - Tom West Bobby Sturgen, Tom West Homes, Inc. , stated that they were requesting a use by exception for an automotive service garage and a contractor with no outside storage in a CG zone at 61-63 West Second Street. The Board determined from visual inspection of the premises that an automotive service garage is already in business and that several abandoned/junked cars were being stored on the premises. After discussion, Ron Gray motioned to defer the request and refer the matter to the proper department for codes enforcement. Ruth Gregg seconded the motion which carried unanimously. OLD BUSINESS Rezoning of Levy Road Area to Commercial General The matter had been deferred from the previous meeting so that opinions from the affected home owners could be obtained. Mrs. Braddock, 1475 Main Street, stated that she had been against the rezoning but that she had changed her mind. She requested that her property be rezoned to Commercial General. Mrs. Peavy, 150 Levy Road stated that she wanted her home zoned commercial. George McGregor, 1460 Violet Street stated that the property is already commercial in character and wished it to be zoned commercial. Ron Gray asked if the residents understood that their homes would be non-conforming under a CG zoning and that they could not expand or rebuild if they were 50% destroyed. The residents acknowledged that they understood the implications. After a general discussion Ruth Gregg motioned to recommend rezoning the area to CG, noting that it is what the people want. Candace Nordan seconded the motion which carried 2 to 1. Ron Gray voted no. After a general discussion on the width of some roads in Section H, annexation, and the proposed ordinance regulating vehicle repair, Ruth Gregg motioned to adjourn.
