07-17-84 v a MINUTES OF THE ADVISORY PLANNING BOARD CITY OF ATLANTIC BEACH July 17 , 1984 7 : 00 P .M. CITY HALL PRESENT: W. Gregg McCaulie, Chairman John W. Morris , Jr. Commissioner Mrs . Ruth Gregg Ron Gray AND: A. William Moss, City Manager Rene' Angers , Recording Secretary AND: John Beck Louis B. MacDonell ABSENT: Guy Jennings Chairman McCaulie called the meeting to order at 7 : 08 p.m. He asked if there were any comments or corrections to be made to the minutes of the meeting of June 19 , 1984 . There being none, Chairman McCaulie declared the minutes approved as presented. * * * * * * * * * * * * * * * * * * NEW BUSINESS Chairman McCaulie called the Board' s attention to the New Business at hand; Item #1 - Request for Rezoning, John Beck - Part of Lots 2 and 3 , Section 16-2S-29E . Mr. Beck, 5315 John Reynolds Drive, Jacksonville, stated that he proposed to change the zoning from RG2 to Commercial Intensive and that he would like to have a car lot and an insurance agency on the site. He added that there are three car lots and several insurance agencies in the vicinity. Ron Gray stated that he was concerned about the drastic change in zoning from Residential General to Commercial Intensive , adding that there are homes north, south and east of the property. Commissioner Morris stated that rezoning the property would result in spot zoning. Ruth Gregg asked Mr. Beck if he planned to have car repair on the lot. Page 2 Advisory Planning Board July 17 , 1984 Mr. Beck replied that he would have car leasing but not repair. Ron Gray stated that CI zoning provides for automobile repair, adding that it also provides for bars , cocktail lounges, drive-in restaurants , etc. . . Mr. Moss pointed out that CI zoning is available directly across the street from the property and extends up to Church Road. He added that it is also available on Atlantic Boulevard. Chairman McCaulie asked if members of the audience would like to comment on the request. Bishop Brown, 70 Dora Street, stated that he was opposed to the change in zoning due to the traffic problems and the possibility of constricting the air flow as other commercial uses have in the area. Rosa Lee Peterson, 76 Dora Street, asked several general questions and seemed to be opposed to the request. At that point, Chairman McCaulie informed Mr. Beck of the one year waiting period if the request is denied and offered Mr. Beck a chance to withdraw his proposal if he wished. Mr. Beck did not want to withdraw. Ron Gray motioned to deny the request for rezoning, primarily due to the radical change from residential to Commercial Intensive, and the presence of surrounding residents opposing the change. Ruth Gregg seconded the motion, which carried unanimously. * * * * * * * * * * * * * * * * * * Chairman McCaulie called the Board 's attention to Item #2 under New Business; Request for Rezoning under a Planned Unit Development, Bull/MacDonell - Part of Section 17 , Township 2 South, Range 29E, and Part of Lot 2 , Section 17 , Township 2 South Range 29E. Louis B. MacDonell , 1535 Selva Marina Drive, introduced himself and stated that he represented his mother, Mildred MacDonell and William A. Bull, Jane E. Bull, and Harcourt Bull,III . Page 3 Advisory Planning Board July 17 , 1984 Mr. MacDonell gave a lengthy description of the proposed Planned Unit Development. He stated that it would be similar in tone to the Marsh Creek, Linkside and Garden Homes subdivision. He stated that they would be patio homes built on zero lot lines . He added that they hoped to price them in a range more affordable than those in the Selva Marina area. Commissioner Morris pointed out that the four acre parcel is separated from the larger parcel by city property and that it does not meet the minimum site requirement of seven acres for a planned unit development. Mr. MacDonell felt that the two parcels could be considered one. There was a discussion on the proposed access road across city property that would join the two parcels . Commissioner Morris stated that it would leave a large portion of city property, approximately 190 ' x 129 ' , unusable. Ruth Gregg expressed concern that the subdivision would be located on a dead-end street. She felt that there should be another entrance. She was also concerned that the traffic would empty onto Seminole Road. Ron Gray stated that he was concerned about the traffic and the proposed access road. He added that the plan does not meet the requirements for open space under a planned unit development. He further added that he was opposed to the proposal. There was a discussion on the close proximity of the waste water treatment plant to the proposed subdivision. Commissioner Morris showed the Board and Mr. MacDonell a site plan of the additions to the plant, including a new 10 million gallon per day sewage treatment plant and a new equalization pond. Mr. MacDonell stated that had he known the location of the new additions to the plant, he would have taken a different approach to the development. At that point, Mr. MacDonell withdrew his request. There being no further business before the Board, Chairman McCaulie adjourned the meeting at 9 :15 p.m. egg cCaulie, Chairman
