A motion was made, and seconded, to approve the minutes of
April 13, 1993.

Suzanne Shaughnessy inquired as to the status of Case no. 0056,
William Blackard, Jr. George Bull presented a letter of
agreement between himself and William R. Blackard, Jr., dated
April 28, 1993, to Don Ford, Code Enforcement Inspector (letter
attached herewith, Exhibit 1). The letter indicated the
stabilization of the northly berm of Mr. Blackard's property
would be as follows: "a two tiered wood retaining structure
would be installed at the Northly berm. The upper most northly
tier to be approximately 35 feet long. The lower tier to be
approximately 15 feet long. Both structures to be backfilled
and grassed with St. Augustine sod. This initial phase to be
accomplished by May 31, 1993."
Mr. Bull indicated if Mr. Blackard did not accomplish what was
set forth in the letter of agreement a stop work order would be
issued by the City.
Case No. 0024 - Thomas L. Jackson, owner of property located at

residential property.) Report by Don Ford, Code Enforcement
Officer.
Don Ford reported he had inspected the property that that 1t
~'1 was in compliance. The board accepted Mr. Ford's report.

Case No. 0057 - Hark Kredell - Complaint filed regarding
property located at 387 Third Street, in violation of Standard
Mechanical Code Section 308.9.3, "Minlmum size of the exhaust
duct shall be 4 inches ID." (3" Duct installed by Hark Kredell
at 387 Third Street)
George Bull read the case hearing procedure for Case No. 0057
and asked witnesses to stand and be sworn in.
Suzanne Green reported there were home owners who lived at 381
and 385 Third Street, who also had 3" dryer ducts installed by
Mark Kredell, present in addition to David Johnson.
Don Ford reported he wrote a letter to Mark Kredell on January
21, 1993 indicating the dryer vent was not installed properly,
and David Johnson wrote Mark Kredell on January 24, 1993
advising the dryer vent was not installed properly. He
reported Mr. Johnson stated he was not able to get a warranty
on his dryer because of the 3" vent. He reported Mark Kredell
had not attempted to correct the situation.
~ City Attorney Alan Jensen advised the Board could only hear the
case on the agenda, David Johnson, 387 Third St.
Mark Kredell reported he had agreed, in writing, to replace the
3" vent with a 4" vent. He indicated he was prepared to do the
job but the homeowners indicated they did not like the
aesthetics of the 4" vent installation he proposed. Fie added
as soon as the property owners gave permission for him to do
the work, he would proceed to do it.
George Bull referred to a proposal to fix the vent provided by
David Johnson (copy attached hereto, Exhibit II). Mr. Bull
indicated although the proposal had been submitted by Mr.
Johnson earlier in the week, Mr. Bull did not feel it would be
proper to have the board study the proposal until the meeting.
Suzanne Green asked David Johnson to present his case. Mr.
Johnson explained a G.E. repair person explained it was not
proper to use a 3" vent. Mr. Johnson called the supplier, and
was told a 4" vent should have been used. He indicated he had
not had a problem with the dryer, but that it took longer to
dry clothes. He indicated he was afraid damage would be caused
to the dryer, and that the situation would be a fire hazard.
Suzanne Green asked Mr. Johnson if Mark Kredell had offered to
change the vent, to which Mr. Johnson replied Mr. Kredell
~ offered to fix it but that the method Mr. Kredell wanted to use
was unacceptable to the homeowners.

Mr. Johnson asked the Board to look at his proposal indicating
~ a method to fix the problem (Exhibit II), which he felt would
.~ work and would not be too expensive.
George Bull asked Mr. Johnson if he had discussed his proposal
with Mr. Kredell, to which Mr. Johnson replied he had mailed
Mr. Kredell a copy of the proposal.
Mr. Kredell indicated Mr. Johnson's proposal violated the
southern Building Code. Mr. Kredell added he was only required
to provide a vent that met the Southern Building Code.
Mr. Martin asked Mr. Kredell if Mr. Johnson's proposal met the
Southern Building Code, to which Mr. Kredell replied it was his
feeling it did not. He added he had contacted three or four
plumbing companies and they used 3" vents, and they indicated
3" vents worked better. Me added the property owners had been
using the 3" dryer vent for some time. He indicated he also
checked with Duval County and he was told this application had
been used ten's of thousand's of times and had not had a
problem. He added it was not a hazard.
A discussion ensued regarding the various ways the 4" vent
could be installed, but no decision was reached.
Mr. & Mrs. Bew, 381 Third Street, and Mr. & Mrs. Lanigan, 385
Third Street, spoke and indicated they were experiencing
problems with the drying working a longer time to dry clothes.
A discussion ensued concerning whether Mr. Kredell had violated
the code, and it was felt by the board members that Mr. Kredell
had violated the code.
A discussion ensued concerning the method used to fix the
problem and it was indicated the problem could be fixed
utilizing Mr. Johnson's proposal, providing the city would be
absolved from any responsibility, since the job would not be
done according to the code of the City of Atlantic Beach. It
was indicated a Hold Farmless Agreement could be furnished to
the City, and placed in the file containing documents relative
to Mr. Johnson's address.
Mr. Johnson felt he would like to make a financial arrangement
with Mark Kredell, absolve Mark Kredell from any further
responsibility with reference to the dryer, have the dryer vent
fixed himself, and provide the City of Atlantic Beach with a
Hold Harmless Agreement with respect to the dryer, only.
The following motion was made and seconded:
Motion: The installation of a 3" dryer duct
installed at 387 Third Street was a violation of
the Standard Mechanical Code, Section 308.9(3)

The question was called and the motion carried unanimously.
~ A discussion ensued between Mr. Johnson and Mr. Kredell, and
Mr. Kredell agreed to pay Mr. Johnson $200.00. Mr. Johnson
agreed to release Mr. Kredell from any responsibility regarding
the 3" dryer duct installed at 38T Third Street. Mr. Johnson
agreed to provide the City with a Hold Harmless Agreement with
reference to the installation of the 4" dryer duct.
It was explained that the Hold Harmless Agreement would speak
to the dryer duct, only.
The following motion was made and seconded:
Motion: Violation (installation of 3" dryer duct
instead of 4" dryer duct at 387 Third Street)
will be brought into compliance with the Code
within one week, by May 11, 1993.
The question was called and the motion carried unanimously.
There being no further business the meeting adjourned at 9:00
p. m.

Builder, regarding the following properties:

FACTS:
Correspondence to Messrs. Ford, Leinbach, Hull, the Builder and
others are already part of the City's file. Whether the
violation was considered or inadvertent on the Builder's behalf
is not the issue. What is at issue, however, is that our present
dryer ventilation system is improper and a potential hazard. It
was installed incorrectly, approved by the City of Atlantic Beach
and, despite City's demands to this Builder to correct, nothing
has been done to date. Given the Homeowners' combined experience
with the Builder, it is not likely he will respond except under
duress - financial or other. This condition of an uncooperative
Builder gives us real concern whether he will satisfactorily
perform the labor needed to remedy this situation. So far, all
he has done is provide a crude drawing which allows for exposed
pipe in the laundry room to be vented into our garages, which is
totally unacceptable: This barely meets code, is aesthetically
unappealing, and would transfer hot, moist air into our garages
presenting additional problems. Our homes, though not the most
expensive in Atlantic Beach, are much too valuable for the type
of ventilation this Builder proposes, not to mention the negative
effect it may have on future sales of these homes.

PROPOSED SOLUTION:
We, as the Homeowners, propose the following correction which is
a 100 improvement over the present condition, places the dryer
exhaust ventilation where it will function well, is aesthetically
satisfactory to all and with no devaluation to said properties.
It can likely be done at a modest cost and in a relatively short
period of time. While this solution, technically-speaking,
misses Code compliance by about six or seven feet, the
improvement will be significant.
Given the design limitations of these homes, it is our opinion
this is clearly the way it should be corrected:
1. Remove laundry room wall segments behind dryer as necessary.
2. Seal off existing 3-inch vent pipes, both in wall and
^ outside of house.
t 3. Feed 4-inch replacement pipe through the 16-inch deep truss
cavity running to the exterior wall.
4. Cut opening in outer wall just as was done when the exhaust
fan serving the lower level bath was installed.
5. Complete exterior with appropriate vent hood. This
installation will be located in the truss cavity adjacent to
the existing bath vent pipe and hood.
6. Reverse the washer and dryer locations. This swap would not
required re-plumbing, only the relocation of the electrical
outlets.
7. Replace laundry wall or segments cut out earlier.
8. Tape, sand, prime and paint.
9. Maintain work area in a clean, orderly state.
REOUESTS:
1. Committee grant any variances necessary to resolve existing
^ problem according to proposed solution.
` 2. Committee grant financial restitution from Builder based
upon the average of three (3) estimates from independent

contractors. Said work to be performed by selected
independent contractor and/or by homeowners in accordance to
proposed solution, subject to city approval.
3. Should our request that work be performed by an independent
contractor and/or homeowners be denied, the Builder should
be required to engage qualified sub-contractors and said
work be scheduled immediately with specific start and
completion dates, and with the over-sight approval of the
City of Atlantic Beach. The Builder and/or subs are to
provide each owner with lien waivers, as all costs are to be
borne by the Builder.
4. That this issue is not resolved until total Homeowners'
satisfaction are met.
We, the Homeowners, thank the Committee and the City of Atlantic
Beach for providing us this opportunity to voice, and we hope,

~-Use only metal duct inside dryer cabinet
or for exhausting dryer to outside.
• Do not terminate exhaust in a chimney,
any gas vent, under an'enclosed floor ,
(crawl space), or into an attic. The accumu-
lated lint could create a fire hazard or
moisture could cause damage.
• Provide an access for inspection and
cleaning of the external exhaust system,
especially at turns. Inspect and clean at
least once per year.
• Never terminate the exhaust into a com-
mon duct or plenum with a kitchen
exhaust. The combination of lint and
grease could create a fire hazard.
• Do not obstruct incoming or exhausted air.

Steps to Change Dryer to Leh Side or Bottom
Exhaust
1. Remove rear access panel.
2. Remove chtct extension back to blower outlet.
3. Using one standard 4" adjustable metal
elbow, a ~VE14X70 Transition and a length of
straight 4" metal ducting (not provided), the
dryer maybe exhausted through the IcCt side
knockout or through the bottom knockout.
NOTE: Only metal duct maybe used inside
the dryer cabinet.
4. Replace rear access panel.

Sealing of Joints
• All joints should be tight to avoid leaks. The
male end of each section of duct must point
away Crom tl)e dryer.
• Do not assemble the ductwork with fasteners
that extend into the duct. They will serve as a
collection point for lint.
• Duct joints can be made air and moisa[re-
light by wrapping the ocerlappcd joints with
duct tape.
