Adjourn MINUTES OF THE REGULAR MEETING OF THE CODE ENFORCEMENT BOARD HELD AT THE CITY HALL ON MARCH 14, 1985 AT 7:30 PM Call to Order: The meeting was called to order by Chairman George Bull,Jr. followed by the pledge to the flag. Roll Call: Present: George Bull, Jr. , Chairman Willie E. Davis Marjorie Dunson Fred Mills Allen R. Salfer Jerome R. Strayve, Members AND: Adelaide R. Tucker, Secretary ABSENT: Alan Potter, excused by the Chairman Claude L. Mullis, Counsel to the Board Approval of Minutes of January 10, 1985 Mr. Mills moved to approve the minutes of January 10, 1985 as presented. The motion was seconded by Mr. Strayve and carried unanimously. Recognition of Visitors and Guests Mr. Bull introduced Richard Fellows, new City Manager, Wayne Royal, Fire Chief, John Widdows, Building Inspector, John Morris, City Commissioner, and Dorothy Kerber, member of the Board of Adjustment, and thanked them for attending the meeting. The Chair recognized Mr. Trevor J. Parker, 172 Poinsettia Street, a resi- dent of Atlantic Beach for eight years. He explained his reason for attend- the meeting was the residents on his street had issued a complaint regard- ing two vehicles parked in the same location for some period of time. Mr. Bull advised the Acting Code Enforcement Officer would bring up the matter later in the meeting. Unfinished Business A. Status Report on Delinquent Occupational Licenses Mr. Bull acknowledged receipt of a status report on delinquent occupa- tional licenses submitted by the City Clerk. Letters were sent to thirty- five businesses that were delinquent in renewing their licenses advising them upon failure to make payment within fifteen days they would be re- ferred to the Code Enforcement Board. Thirty-four were resolved within days. The other one has made partial payment. Mr. Bull commented that was the way the Board should operate. All Board members acknowledged receipt of copies of the new Code. Mr. Bull instructed the secretary to also furnish each board member with a zoning map. Mr. Mills complimented the City Manager, City Attorney, and Municipal Code on the preparation and indexing of the new Code *See corrected page 2 PAGE TWO MINUTES-CODE ENFORCEMENT BD. Recommendation of Code Enforcement Inspector Mr. Bull acknowledged receipt of a letter from Mr. Fellows, City Manager recommending Chief Royal be appointed as the Code Enforcement Officer. He commented that Mr. Royal was presently serving as Acting Code Enforce- Officer. Mr. Bull suggested the Board recommend the Commission appoint Chief Royal as Acting Code Enforcement Officer for a certain period of time, due to the uncertainty of what the Legislature will do in regards to expanding the Board's responsibilities. If the Legislature expands the Board's responsibilities to such a point that it would take away from his responsibilities as Fire Chief, then it might be necessary at that time for the city to hire a full time Code Enforcement Officer. The motion was made by Mr. Mills to recommend the Commission appoint Chief Royal as Acting Code Enforcement Officer for six months. The motion was seconded by Mr. Davis and carried unanimously. B. Status Report on Complaints of Violations The Chairman acknowledged receipt of status report on complaints of violations submitted by Chief Royal, Acting Code Enforcement Officer. He advised that all complaints had been resolved. Mr. Alex Vargo, 167 Poinsettia asked to be recognized. Mr. Bull explained to Mr. Vargo the Board, by Ordinance, could not seek out any violations. They act as a Board to rule on violations that are presented to them only through the Code Enforcement Officer or other representative of the City. The Board could not hear complaints or arguments from the citizenry. There had to be a chain from the citizen to the city and then to the Code Enforcement Board. Mr. Vargo explained he and Mr. Parker were there repre- senting thirteen citizens on Poinsettia who disagree with the allowance of the vehicles to remain parked in a yard. Mr. Bull advised Mr. Vargo to bring the matter to the attention of the City Manager or request to be placed on the agenda and bring it to the attention of the City Commission. The fact that the citizens disagreed with the findings of the Code Enforce- ment Officer was not a matter the Board could take up directly with Mr. Vargo and the other citizens. That was not their function. Mr. Vargo said he would contact the City Manager for a continuance of the case. * * * * * * * * * * * * * * * * * * * * * * * The Board discussed how complaints are received by the city and Chief Royal detailed the procedures and showed the Board copies of the forms used. After review the Chairman requested each complaint form also show what section of the Code it was in violation of. Mr. Bull stated he would not consider a case brought before the Board unless the Code Enforcement Officer had received the complaint in writing and who it was from, rather than phone calls, hearsay, etc. He said the citizens had to be very careful they didn't get into "nit-picking witch-hunts" among the neighbors. Chief Royal showed the Board copies of the forms he used and detailed the procedures he followed. After review the Chairman request- ed each complaint form also show what section of the Code it was in viola- tion of. The Board agreed unanimously with Mr. Bull. MARCH 14, 1985 Board Members Comments Mr. Mills and the other board members expressed pleasure over the effec- tiveness of the Board in relation to occupational licenses. Mr. Davis also expressed his appreciation of the new Code and commented it was so easy to research. Commissioner Morris thanked each member of the Board for their interest and participation. He said they had accepted a very serious appointment and thanked them kindly for their time donated to the city. The Board was needed for a long time.
