CODE ENFORCEMENT BOARD MINUTES
SEPTEMBER 3, 2002

The meeting was called to order at 7:30 p.m. by Chairman Sanders, followed by the Pledge of
Allegiance by all present.
Chairman Sanders requested that the roll be read. Secretary Shearer read the roll and determined
that there was a quorum.
1. Approval of the Minutes of the Regular Meeting held on March 5, 2002.
Following a brief review of the minutes, a motion was made by Board Member Mann,
seconded by Board Member Breault unanimously carried to approve the minutes of the
Code Enforcement Board Meeting of March 5, 2002.
2. Recognition of Visitors and Guest regarding any matters not listed on the agenda.
Introduce new secretary, Athena Shearer.
There were no visitors or Guests present. Chairman Sanders introduced the new Code
Enforcement Secretary, Athena Shearer.
3. Unfinished Business from previous meeting:
Mr. Sherrer explained that Benjamin Brown, Jr., Case No. 075-01, is making his payments on
time. There have been more complaints, but he is in compliance within the City's Code. Mr.
Brown verbally agreed to keep all items behind his fence, but the agreement was not in the
minutes from the May 1, 2001 meeting. Mr. Sherrer stated that the minutes would be sent to all
board members one week after each meeting for corrections for future meetings.

4. Public Hearing:
Chairman Sanders read the case information for the new case and read the description and
conduct information for the proceeding. Witnesses were sworn in.
New Case: Case No.: 651-01, Kelly & Ruth Wilson, 615 Atlantic Blvd., Atlantic Beach,
FL, Chapter 17, Section 17-9 BUSINESS SIGN EXTENDING ABOVE CITY
RIGHT OF WAY
Mr. Sherrer presented evidence of the Code in Violation, Proof of Ownership Exhibit #1, Proof
of Violation Notification Exhibit #2, Proof of Hearing Notification Exhibit 3, and photographic
Evidence of Violation Exhibit 4. He also summarized the case and stated that the owners were
first notified of the violation in August 2001 and are still in violation as of the date of this
hearing. He described that in July he started receiving complaints about signs in Atlantic Beach
being in violation of the City's Sign Ordinance, which prompted his investigation into all the
signs in Atlantic Beach.
Chairman Sanders asked for time to review the Exhibits.
The Chairman called Ruth Wilson.
Ruth Wilson stated that she had contacted three companies to redesign their sign to meet the
City's Sign Ordinance and that Mr. Taylor was the most knowledgeable businessman. She said
she was not clear on the restrictions set forth in the Sign Ordinance and neither was Mr. Taylor.
She was told by Mr. Taylor their sign would be "grand fathered in" later. They want to redesign
the sign to improve its appearance and to be visible from traffic on Atlantic Boulevard. The sign
was originally permitted many years ago. Mrs. Wilson said she would like recommendations on
what they can do to replace/redesign the sign to be in compliance with the code.
Mr. Sherrer stated that all sign companies must get approval from the building and zoning
departments. Kelly and Ruth Wilson need to meet with the zoning department to discuss what
kind of signs are permitted within the City of Atlantic Beach Florida.
Discussion among the Board Members ensued.
The Chairman stated that Kelly and Ruth Wilson are found guilty of Chapter 17, Section
17-9 BUSINESS SIGN EXTENDING ABOVE CITY RIGHT OF WAY
A Motion was made by Board Member Wynkoop to give Kelly and Ruth Wilson two weeks
beginning September 3, 2002, to submit sign plans/designs to the zoning department and

two weeks after that to get the sign in compliance and any extensions in time requested by
the contractor must be approved by Mr. Sherrer, seconded by Board Member Mann. The
Motion carried unanimously.
Mr. Sherrer requested that Kelly and Ruth Wilson pay the Administrative Fees pursuant to
Florida Statute 162.07 and the Code of Ordinances of the City of Atlantic Beach Florida in the
amount of $495.83.
A Motion was made by Board Member Wynkoop to charge Kelly and Ruth Wilson $495.82
for Administrative Fees, seconded by Board Member Mann. The Motion carried
unanimously.
Chairman Sanders recommended that Kelly and Ruth Wilson meet with Sonya Doerr, Planning
& Zoning. Mr. Sanders also requested that the minutes be sent out within one week for
corrections and confirmed this with the secretary.
The Chairman declared the hearing closed.
5. New Business:
Mr. Sherrer commented on the monthly Code Enforcement Report for August 2002. He
pointed out that signs, abandoned vehicles and trash were the most frequent violations and
that we are having some problems with new businesses getting their licenses prior to
operating.
6. Board Member Comments:
The Board briefly discussed the monthly Code Enforcement Report "Attachment A".
7. Adjournment:
There being no further discussion or business to come before the Board, the meeting adjourned at
8:20 p.m.
