Board Members Comments Adjournment MINUTES OF THE CODE ENFORCEMENT BOARD MEETING HELD AT CITY HALL ON JANUARY 8, 1991 AT 7:30 P.M. CALL TO ORDER Present: George Bull, Jr. , Chairman Mattie Freeman, Vice Chairman Heywood Dowling, Jr. Edward Martin Herbert Moller And: Suzanne Bass, Prosecuting Attorney Alan Jensen, Legal Council to Board Don Ford, Code Enforcement Officer Dorothy M. Strain, Secretary Absent: William J. Dorsey, Excused Mary Lyle Perry, Excused 1. Approval of Minutes of October 2, 1990. Mr. Dowling moved for approval of the minutes of October 2, 1990 as written. The motion was seconded by Mr. Moller and carried unanimously. * * * * * * * * * * * * * 2. Recognition of visitors and guests - Chairman Bull welcomed Dorothy Strain as the Board' s new secretary and assistant to the City Clerk, Maureen King. * * * * * * * * * * * Mr. Bull made mention that his term of office had expired and he was reappointed in December . Mr . Bull moved to elect a new chairperson. Mr. Dowling made a motion to reelect Mr. Bull as chairperson and Mrs . Freeman seconded the motion and carried unanimously. * * * * * * * * * * * 3. Old Business Case #0013 - Francisco Rebelo to report on progress being made to bring his business at 1651 Mayport Road into compliance with the order of the Code Enforcement Board. Mr. Ford understood that the board had required that Mr. Rebelo was to report as to when he was going to complete the clean up of the outside storage and/or construct a building as an alternative . The board had not previously set a timetable due to the poor economy. Mr. Bull then called on Mr. Rebelo for his update. Mr. Rebelo stated that he had made an attempt to sell his business . He had also investigated the possibility of constructing a larger building. He also stated that he had removed about 90% of the unusable equipment. Mr. Rebelo stated that being a small business he is trying to survive economically and was doing what he could to Code Enforcement Board Meeting January 8, 1991 Page 2 comply with the laws of the City of Atlantic Beach. Ms. Bass asked Mr. Rebelo if the equipment still remained behind the fence. He responded that he was in the process of cleaning it up. Ms. Bass then asked what was his plan to construct a building to house the equipment in question as previously discussed with the board. Mr. Rebelo stated he could not meet the obligations set by the banks to receive financing. So he has chose to reduce the size of his business and continue to make a living. There was discussion regarding whether the truck and trailer on the south edge of the property still remained. Also, whether the fence located behind the building was actually on his property boundry line. Mr. Rebelo replied that the vehicles were used to haul to debris to other locations and once the debris is removed the trucks will be relocated. He also stated that his property line is located beyond the fence in question. Ms. Freeman asked what progress had been made since the last Board meeting with the clean up. He responded that he had cleaned away 5% of the debris since the last meeting and has completed 60% of the total clean up. Mr. Dowling stated the next meeting was scheduled the day after the April 1, 1991 deadline. Mr. Dowling moved to change the deadline to April 3, 1991. The motion was seconded by Mr. Moller and carried unanimously. * * * * * * * * * * * 5 . Case #0014 - Joseph Nadeau to report on the progress being made to bring his property at 105 West Sixth Street into compliance with city ordinances. Mr. Bull called on Mr. Ford for a report . Mr. Ford stated that he had inspected the property in question on January 7, 1991 and the debris had been cleaned up to his satisfaction . ( Before and after photographs had been submitted to the Board at that time) . Ms. Bass asked if the van, which was seen in both before and after pictures, was operable. Code Enforcement Board Meeting January 8, 1991 Page 3 Mr. Nadeau stated the white van was used on a daily basis and the blue van was also operable. He stated he was in compliance with the City' s ordinance and wished the case to be closed. Mr. Bull suggested since Mr. Ford felt Mr. Nadeau had complied with the City Ordinances, the case should be closed. Ms. Bass suggested that Mr. Ford' s recommendation was to have the Board decide whether or not this case should be closed based on his report. The Board discussed the closing of this case. Mr . Moller moved to close this case since Mr. Nadeau was in compliance with the City' s Ordinance. The motion was seconded by Mr. Dowling and carried unanimously. * * * * * * * * * * * Mr. Ford brought to the attention of the Board Section 2-143 in the Code of Ordinances of the City of Atlantic Beach. He quoted "The meetings of the Board shall occur no less frequently than every two months. The Board may meet more often if necessary. " After brief discussion the Board agreed to change the schedule of meetings from once every three months to bimonthly.
