03-25-98 v CITY OF ATLANTIC BEACH CODE ENFORCEMENT BOARD MINUTES SPECIAL CALLED MEETING MARCH 25, 1998 Call to order: PRESENT: Ken Rogosheske James Pelkey Lou Etta Waters Robert Etheridge Richard S. Mann Tami Deitchman Curtis M. Sanders, Jr. AND: Alan Jensen, City Attorney Karl Grunewald, Code Enforcement Officer Julie M. Brandt, Secretary The meeting was called to order at 7:30 p.m. by Code Enforcement Officer Grunwald who explained that the purpose of the Special Called Meeting was to elect a Chairman and Vice Chairman. It was agreed by the Board Members to suspend use of Robert's Rules of Order for the selection process of Chairman and Vice Chairman. A brief discussion ensued, and it was the consensus of the newly appointed Board Members that experienced members of the Board should serve in the positions of Chairman and Vice Chairman. After some further discussion, Ken Rogosheske agreed to serve as Chairman and Richard Mann as Vice Chairman. The Board Members unanimously approved the selections and thanked Mr. Rogosheske and Mr. Mann for their willingness to serve. Following the selection of the Chairman and Vice Chairman, the Board went into a Workshop Session to discuss procedures for conducting a Code Enforcement Board Hearing (Quasi-Judicial Proceedings, Florida Statutes 162 (Code Enforcement Boards), and the upcoming Code Enforcement Officers Conference on June 18-20, 1998. City Attorney Jensen advised the Board to act on all evidence and to keep within the limits of the law when conducting the hearing, and then briefly explained quasi-judicial proceedings (FS 162.07). A question and answer session ensued, and Board Member Sanders inquired regarding conflict of interest when hearing a case. City Attorney Jensen advised that the only acceptable reason for declaring a conflict of interest would be financial gain. There being no further questions, City Attorney Jensen left the meeting at 8:00 p.m. Code Enforcement Officer Grunewald distributed information concerning two different methods for conducting a Code Enforcement Board Hearing and copies of Chapter 162 to each member. Enforcement procedure, conduct of the hearing and the powers of the Board were briefly discussed. Chairman Rogosheske requested that the printed procedure be provided at each meeting. Code Enforcement Official Grunewald reported that the Code Enforcement Officers Conference would be held on June 18 - 20, 1998 at Sanibel Harbour Resort in Fort Myers and urged the Board Members to take advantage of an opportunity to receive the information and training offered at the conference. Jim Pelkey stated he had not received a copy of the City of Atlantic Beach Code Book. Secretary Brandt stated she would have a copy for him by the end of the week.
