1. Approval of the minutes of the meeting of January 5. 1993
On motion made by Edward Martin, seconded by Kathleen Russell, the
minutes of the meeting of January 5, 1993, were unanimously
approved.

George Bull, Chairman, welcomed Maureen King who was substituting
for Trudy Lopanik, Secretary, who was ill.
3. Old Business
Report by Don Ford: Case No. 0022 - Charles Watson. Uadate on
condemnation concerning nrooerty located at 270 Maynort Road and
adjacent vrooerty.
George Bull read a letter from Mr. Watson requesting a 60-day
extension for the completion of demolition of the structures at 270
Mayport Road. Mr. Watson indicated the building would have been
demolished by the deadline set by the board but the contractor had
experienced a problem with asbestos. Mr. Watson reported he had
obtained the necessary DER permits but because of the special
handling, the additional time would be needed. Mr. Watson also
provided documentation from the contractor and DER verifying this
information.
Code Enforcement Officer Ford indicated he was satisfied with the
progress being made and recommended approval of the additional
sixty days.

Edward Martin moved to approve the sixty day extension. The motion
was seconded by John Venn and following brief discussion, was
unanimously approved.
Report by Don Ford: Case No. 0052 - Mr. Terry Kirton, owner of
property located at Royal Arms Apartments, Lots 580, 587, 588, 589,
590, 591, 592, and Lot 17, Block 27, in violation of Standard
Building Code Section 1116, Existing Guardrails are Rusted and
Falling Apart
Don Ford reported new guard rails had been installed by the
deadline established by the board and the property was no longer in
violation. Mr. Bull requested that a letter be directed to Mr.
Kirton thanking him for his prompt compliance.
Report by Karl Grunewald: Case No. 0053 - Sandra Kovir, owner of
property located at 808 Cavalla Road, in violation of Sections 12-

Karl Grunewald reported the property was now in compliance and
looked very well. Mr. Bull requested a letter be sent to Ms. Kovir
('1 thanking her for her compliance.

George Bull read the case hearing procedure for Case No. 0054, and
at this time Mr. Bull asked witnesses in this case and Case No.
0024 to stand and be sworn in. (Case No. 0055 was in compliance
and no witnesses were in attendance).
Suzanne Green explained Mr. Ash had commercial vehicles such as
school buses, heavy equipment, and abandoned vehicles stored on
residential property. She asked Karl Grunewald to present the
evidence and pictures.
Karl Grunewald explained upon investigating a complaint from a
resident he became aware that the property was zoned residential.
He distributed pictures of the vehicles stored on the property.
Mr. Grunewald explained a building permit had been issued in 1982
to construct a mini warehouse, but no construction other than a
^ concrete slab had ever been undertaken.

Mike Ashourian indicated he had owned the property for about one
year and said that the mini-warehouse had been in existence about
twenty years and he thought cars had been parked in the area now
being used for storage during that time. Mr. Ashourian felt the
zoning of the property was such that mini-warehouses would be a
permitted use. He asked for direction regarding having the
property rezoned or securing a variance which would allow mini-
warehouses.
Following notification of the violation Mr. Ashourian said he had
instructed his manager at that facility to write to the owners of
the buses and ask that they be removed.
Don Ford explained the zoning was changed on the property in
question in 1982. The owner that time pulled a permit a started
construction so that he would be grandfathered in when the zoning
changed. Construction was never completed so the operation of
mini-warehouses was not grandfathered in at that location.
Mr. Ashourian indicated he had leases with the eight individuals
who has stored their vehicles there. He requested adequate time to
^ contact the vehicle owners and get the vehicles removed.
t Following further discussion, Edward Martin moved to allow Mr.
Ashourian an additional sixty days to remove the abandoned vehicles
stored in the residential district and bring the property into
compliance, and report back to the board at its next meeting
regarding his plans for rezoning. The motion was seconded by
Heywood Dowling and, following brief discussion, was unanimously
approved.
Case No. 0055 - Robert Wiles - owner of orooerty located at: 347

Suzanne Green reported Mr. Wiles had rectified the problem and was
now in compliance with the city code. No action was necessary from
the board.

Suzanne Green reported Mr. Jackson was charged with storing
abandoned and junk vehicles in a residential district at 463 irex
Road. She explained this was the second time Mr. Jackson had
appeared before the board for a similar violation and recommended
that a fine be imposed.
Karl Grunewald distributed photographs of the abandoned vehicles on
the property. He said it was difficult to tell exactly how many
vehicles were involved since some of them were covered by canvas
but appeared to be inoperable and abandoned, and, further he and
Mr. Ford had been denied access to the property. Mr. Grunewald
also inquired regarding how many vehicles could be stored on
residential property before it would be considered a violation.
Mr. Jackson felt that his vehicles were not junk and were not
abandoned. He indicated his vehicles were covered and were parked
on concrete.
Edward Martin inquired into the status of the vehicles that were
under cover and asked Mr. Jackson whether it was his intent to
repair and sell the vehicles. Mr. Jackson indicated he enjoyed
tinkering with vehicles; these were his personal vehicles and he
~~ did not intend to sell them.
Mr. Dowling inquired whether the vehicle in the back yard was there
the last time he appeared before the board. Mr. Jackson said that
it was not. Mr. Dowling felt it was unfair to the neighbors to
park a car in a back yard for long periods of time.
Discussion then ensued regarding the exact nature of the violation
and it was determined Mr. Jackson owned four vehicles which were
inoperable as follows: 1980 Gold Chevrolet Beretta, 1973 Blue
Volkswagen Bug, 1968 Blue Volkswagen Bug, and 1973 Red Bradley GT.
Mr. Martin felt Mr. Jackson did not take seriously the work of the
board. He felt the situation had not changed since the last
hearing and he suggested Mr. Jackson either bring the vehicles into
compliance or remove them.
Following further discussion, Mr. Dowling moved to require Mr.
Jackson to either remove or bring the four vehicles which had been
specifically identified as abandoned, into compliance by March 15,
subject to 550.00 per day fine. The motion was seconded by
Kathleen Russell. Following brief discussion, the question was
called and the motion was approved on a 6 - 1 vote with George Bull
voting nay.
Mr. Jackson said it would be impossible for him to be in compliance
n by March 15 and requested additional time to comply with city

codes. In response to a question from Mr. Martin, Mr. Jackson said
he needed at least thirty days to come into compliance. Edward
Martin made a substitute motion to allow Mr. Jackson 45 days to
either bring the abandoned vehicles into compliance ar remove them
from the property, or be subject to a 550.00 per day fine. The
motion was seconded by Mr. Venn and was approved an a 4 - 3 vote
with Suzanne Shaughnessy, Heywood Dowling, and Kathleen Russell
voting nay.
5. Board Member Comments
There being no further discussion, Mr. Bull declared the meeting
adjourned at 9:05 PM.
