MINUTES OF THE MEETING OF THE CODE ENFORCEMENT BOARD
HELD AT THE CITY HALL ON APRIL 3, 1986 at 7:30 P.M.
CALL TO ORDER The meeting was called to order by Chairman George
Bull, Jr. , followed by the pledge to the Flag.

APPROVAL OF THE MINUTES of January 9, 1986. There being no corrections, additions,
deletions or changes, Mr. Fred Mills moved that the minutes be accepted as written
and Mr. Allen Salfer seconded the motion.
RECOGNITION OF VISITORS: Chairman Bull duly recognized, The Honorable Mayor William
S. Howell and Mr. Richard Fellows, City Manager as outstanding visitors to this meeting.
After the roll call, Mr. Bull addressed the Mayor with the request that the Mayor
and Commissioners appoint a new member to the Code Enforcement Board to replace
Mr. Willie E. Davis, who resigned.
UNFINISHED BUSINESS: MOTION TO RECONSIDER THE CASE OF THE CITY OF ATLANTIC BEACH
vs. MR. RAYMOND L. DAGLEY, SR. Mr. Bull addressed Mr. Alan Jensen, Attorney for
Mr. Dagley, asking if Mr. Dagley had any objection to this motion. Mr. Jensen answered
in the affirmative but promptly stated that perhaps Mayor Howell would have a statement
with which to address the Board. In the interest of proper procedure, Mr. Mullis noted
that Ms. Bass, Prosecuting Attorney for the City of Atlantic Beach should make her
presentation to the Board. Ms. Bass stated that she would request the Board to Defer
the Motion to Reconsider as previously filed pertaining to the Dagley matter, in as
much as Pending Negotiations are at this time occuring which could perhaps render
the motion, mute. Mr. Jensen joined with the Prosecuting Attorney in moving that the
Board defer action pending the outcome of negotiations waiving any time limit until the •
final negotiations with the City can be resolved. Mr. Mullis clarified that the case
is still pending before the Code Enforcement Board, and the motion is that any action
tonight be deferred until further notice, pending the outcome of the possible negoti-
ations of some kind of compromise. Mr. Bull, as Chairman, granted the request of the
City and the Respondent as stated above.
NEW BUSINESS: Case of the City of Atlantic Beach vs. David Shadwell, 335 Sailfish
Drive, Atlantic Beach, Florida 32233 : Mr. Bull announced that the Code Enforcement
Officer, Mr. Frank Kerber, states that Mr. Shadwell's property looks like "Epping
Forest". Mr. Kerber provided pictures taken at 500 P.M. today and informed the Board
that the yard has been cleaned, the grass cut and edged, and all automotive pieces
and parts have been removed and the property looks as good as any of his neighbors' .
Mr. Kerber stated that he would like to withdraw the action against Mr. Shadwell as
he was in compliance as of 5:00 P.M. The Board complimented Mr. Kerber's action in
this case and accepted the determination thereof.
There being no further business to come before this Board, Mr. Alan Salfer moved
Ill-at this meeting be adjourned and his motion was seconded by Mr. Fred Mills. Mr.
Bull, adjourned the meeting at 7:40 P.M.
