07-11-95.:.. CITY OF ATLANTIC BEACH CODE ENFORCEMENT BOARD AGENDA 7:30 P. M., JULY 11, 1995 Call to order Pledge to the Flag Roll Call 1. Approval of the minutes of the meeting of May 2, 1995. 2. Recognition of Visitors and Guests regarding any matters that are not listed on agenda. 3. Old Business: Report of Revin Rissmiller: Case No. 0090 -Rita Elitech - owner of property located at 386 Sargo Road - in violation of Section 12-1-(7) - abandoned vehicles. (At the meeting of May 2, 1995 the Board took no action but voted to allow Revin Rissmiller, grandson of Rita Elitech, the opportunity to give a report after 60 days, at the neat regularly scheduled meeting of the Board). The Code Enforcement Officer will report on the following cases: Case No. 0085 - Joseph Romano - owner of property located at 1170 Begonia Street - in violation of Sections 20-52, no occupational license, 20-52.1 - inspections, and Florida Statute 489.127 - Prohibitions; Penalties. (Don Ford will report). Case No. 0091 - Joseph J. Romano - owner of property located at 1170 Begonia Street - in violation of Section 12-1-(7) - outside storage of building material (stored behind open gate off Tulip Street); Section 16-7 -depositing of building material. (At the meeting of Nay 2, 1995 the Board voted to find the property to be a health hazard and to request [he city to take whatever action vas necessary to clear the property, with the cost of clearing the property to be brought back to the city via a lien against the property). Rarl Grunewald will report. Case No. 0087 -Archie Lee - owner of property located at 752 Cavalla Road - in violation of several sections of Standard Housing Code relative to the interior of the premises. (At the meeting of May 2, 1995 the Board voted to give Archie Lee 48 hours to repair remaining items still in violation or a fine of i50 per day would be installed against the property). Rarl Grunewald will report. n Complaint against 836 Bonita Street. At the meeting of May 2, 1995 several property owners appeared and complained against vacant property at 836 Bonita Street. The Board asked Karl Grunewald to meet with Issac Green on Tuesday, May 3, 1995 to examine the property and overgrowth of hedges. Karl Grunewald will report. Officer Trudy Lopanik, Secretary 1. Approval of Minutes of May 2, 1995. A motion was made, seconded, and passed to approve the minutes of the meeting of May 2, 1995. 2. Recognition of Visitors and Guests regarding any matters that are not listed on agenda. Richard Johnson, 857 Bonita Road, inquired if 845 Bonita Road was on the agenda. He indicated there was a problem of junk vehicles and he reminded the Board that he brought this to their attention at the last meeting. Karl Grunewald reported Mr. Johnson attended the City Commission meeting of July 10, 1995 regarding the problem. Hr. Grunewald explained at the last meeting of the Board held on May 2, 1995 he was scheduled to meet with Issac Green, who lived at 824 Bonita, on May 3, 1995 to examine the problems on Bonita Road. Mr. Green, however, did not keep the appointment, Mr. Grunewald explained. Mr. Grunewald explained he had examined the property at 836 Bonita and it was clean on the Inside. Since the property was overgrown, however, he cited the property for overgrown lawn. Also, Mr. Grunewald explained, he addressed the problem of abandoned cars at 845 Bonita by contacting the owner and explained that all abandoned vehicles had to be removed. Since that time, Mr. Grunewald explained, there was one car which was legally registered and another car that was covered and it was not visible as to whether or not the covered car was legally registered. He reported there was a car on jacks in front of the house on the street which had been tagged with a notice to remove within 72 hours or it would be towed away. Mr. Grunewald indicated he was doing everything he could legally. He - explained 836 Bonita was not in violation of city codes. He indicated • ~ Minutes, Page 2 ~ staff saw no evidence of the sale of drugs which had been reported by Mr. Johnson. Mr. Martin explained that the Code Enforcement Officer would keep a close eye on the properties under discussion. Ne suggested that Mr. Johnson contact Mr. Grunewald when the grass at 836 Bonita became over a foot tall, and 1f the property was not cut within the time limit the owner would be brought before the board. It was explained if a second violation occurred the property would be found in violation the day it was noted by the Code Enforcement Officer. 3. Old Business: Suzanne Green asked that Case No. 0092 - Craig Beatty (owner of property located at 1215 Begonia Street - in violation of Section 16-8 - Fees and collection for pick-up of solid waste) be stricken from the agenda. She explained a settlement had been reached between the city and the property owner. The board concurred. Report of Revin Rissmiller: Case No. 0090 -Rita Elitech - owner of property located at 386 Satgo Road - in violation of Section 12-1-(7) - abandoned vehicles. Kimberly Rissmiller explained the court case had been solved and that since the cars on the property were no longer being held as bond, they would be moved during the upcoming weekend. A motion was made, seconded, and passed to find the property in violation of section 12-1(7). The Board voted to give Revin Rissmiller until Monday, July 17, 1995 to bring the property into compliance to the satisfaction of the Code Enforcement Officer. If the property was not brought into compliance a X50 a day fine would be imposed against the property until compliance vas achieved. Case No. 0085 - Joseph Romano - owner of property located at 1170 Begonia Street - in violation of Sections 20-52, no occupational license, 20-52.1 - inspections, and Florida Statute 489.127 - Prohibitions; Penalties. Don Ford reported three cases were pending against Mr. Romano at the State Attorneys office. He indicated city staff had turned over one case to the State Attorney. Mr. Ford recommended not pursuing any further action pending the outcome of the case. It was decided to keep the case on an active basis. Case No. 0091 - Joseph J. Romano - owner of property located at 1170 Begonia Street - in violation of Section 12-1-(7) - outside storage of building material (stored behind open gate off Tulip Street); Section 16-7 - depositing of building material. Karl Grunewald reported he presented this case to the City Manager and he was in agreement to have the city clean the property, after consulting with the City Attorney. The City was still in the process of clearing the property, and Mr. Grunewald indicated he would report concerning the matter a[ the next code meeting. Case No. 0087 -Archie Lee - owner of property located at 752 Cavalla ` ' ' Minutes, Page 3 Road - in violation of several sections of Standard Housing Code relative to the interior of the premises. Karl Grunewald reported the property was in compliance. Complaint against 836 Bonita Road - this was acted upon earlier in the agenda. 4. New Business: Case No. 0092 - Craig Beatty - owner of property located at 1215 Begonia Street - in violation of Section 16-8 - Fees and collection for pick-up of solid waste. (This was removed from the agenda earlier in the agenda) Case No. 0093 - Gloria J. Casterline - owner of property located at 1080 W. Plaza Street - in violation of Section 12-1-(7) unregistered abandoned motor vehicle in yard. Mr. Martin read the case hearing procedure for Case No. 0093 and all witnesses were sworn in. Suzanne Green reported the property was first cited in 1992, and the vehicle was impounded in 1993. It was taken out of impoundment and cited again in 1994. Karl Grunewald passed out photographs of the vehicle at the site. He reported the vehicle was originally stored in front of the house and there were several other abandoned vehicles. He cited all the vehicles and they were removed with the exception of the vehicle under discussion. The vehicle was impounded February 24, 1993. Now, he reported, the vehicle was in evidence at the property again. On December 15, 1994 the occupant was notified the vehicle had to be removed or it would be towed away. As of today, July 11, 1995, he reported the vehicle was still in the yard. Gloria J. Casterline indicated she was the owner of the car. She added the car had never been impounded. She indicated she took a tag off a Chevette and put it on the car under discussion. The car was in Ocala and it was registered there, she explained, but the car was never impounded. Ms. Casterline indicated she would have the car out of the yard by noon tomorrow (July 12, 1995). She indicated she already had made arrangements to have this done. A motion was made, seconded, and passed to find the property of Gloria J. Casterline to be in violation of Section 12-1-(7). The board voted to give Cloria J. Casterline until Friday, noon, July 14, 1995 to bring the property into compliance to the satisfaction of the Code Enforcement Officer. If the property vas not brought into compliance a ¢50.00 a day fine would be imposed against the property until compliance was achieved. I, 5. Request for lien action: None .. , Minutes, Page 4 6.
