11/12/03 v""' CITY OF ATLANTIC BEACH CODE ENFORCEMENT BOARD MINUTES NOVEMBER 12, 2003 Call to order: PRESENT: Curtis Sanders, Chairman Richard Mann Ray Breault Christopher Shea Mamie Hurd AND: Alex Sherrer, Code Enforcement Officer, Alan Jensen, City Attorney Ellen LaVake, Secretary ABSENT: Carl Russell (excused) Peter Wynkoop The meeting was called to order at 7:00 p.m. by Chairman Curtis Sanders, followed by the Pledge of Allegiance to the Flag. The Secretary read the roll, finding that Board Members Carl Russell and Peter Wynkoop were absent. Carl Russell called the Code Enforcement Officer and said he would be unable to attend the meeting.. 1. Approval of the Minutes of the Meeting held on October 15, 2003 Chairman Sanders asked for a motion to accept the minutes as presented. A motion was made by Board Member Shea, seconded by Board Member Breault and unanimously carried to accept the minutes as presented. 2. Recognition of Visitors and Guests regarding any matters that are not listed on the agenda. There were no visitors or guests present at the meeting. 3. Unfinished Business: Code Enforcement Officer Alex Sherrer reported on the following cases: A. COMPLIANCE: (1). Case No.: 537-03, Mr. Benjamin Brown, Jr., 457 Sailfish Drive ,Atlantic Beach; Code Enforcement Officer Sherrer reported that Mr. Brown had cleaned up his yard and removed all illegal items. He reported no new activity was being conducted on the -- premises, and the property was now in full compliance. (2). Case No.: 1331-02, Mrs. Valda Hector, 387 Skate Road, Atlantic Beach; Code Enforcement Officer Sherrer reported that the illegal shed had been torn down and the property was in full compliance. (3). Case No.:1270-02, Mr. Yoochun Won, 1480 Mayport Road, Atlantic Beach; Code Enforcement Officer Sherrer reported that Mr. Won was in full compliance before the last hearing was held. 4. New Business: Case No.: 1331-02: Mr. Lincoln Casimir, representing Mrs.Valda Hector, requested to appeal the fine that was issued on October 15, 2003, for failure to comply with Code Enforcement Board order. Mr. Casimir claimed there were extenuating circumstances. Mr. Casimir asked the Board to consider waiving the fine of $3,750.00 imposed on Mrs. Hector due to the fact that she had been in the hospital and was currently unemployed and had no money. He said he had been trying to help her and planned on starting to remove the shed material from the property this weekend. Code Enforcement Officer Sherrer recommended that the fine be held in reserve and if the property was cleaned up by the end of the month the fine would be negated. Board Member Shea asked Mr. Casimir how long it would take him to clean up the property. Mr. Casimir said he thought it should take about a week. Board member Hurd asked Mrs. Hector to address the board. Mrs. Hector apologized and said she had been trying to resolve the matter. A motion was made by Board Member Shea, seconded by Board Member Hurd, and unanimously carved to approve the recommendation of the Code Enforcement Officer to set aside the $3,750.00 fine until December 1, 2003 pending the complete clean up of the property. If it has been cleaned up at that time the fine would not be reinstated. 5. Miscellaneous Business: Code Enforcement Officer Sherrer asked the board members to review the copy of the Code Enforcement Investigation Report for October 2003 and asked if there were any questions. Board Member Breault inquired about the increase of vegetation violations. It was explained that due to a complaint to the City Commission, the Code Enforcement Officer investigated all of the City rights-of--way for excessive growth and obstruction. 6. Board Member Comments: Chairman Sanders asked the Board members if they would support a proposal to go before the City Commission to request a program be set up that would require the 2 inspection of rental properties in Atlantic Beach. Mr. Sanders provided information on ~.•. programs in other cities that have inspections of rental properties. After further discussion a m otion w as m ade b y Board M ember S hea , se conded b y Board M ember Hurd, and unanimously carried to support Chairman Sander's proposal to go before the City Commission for futher evaluation of implementing a program for inspections of rental properties. 7.
