CODE ENFORCEMENT BOARD MINUTES

The meeting was called to order at 7:00 p.m. by Chairman Curtis Sanders, followed by
the Pledge of Allegiance to the Flag.
The Secretary read the roll, finding that Board Member Ray Breault was absent.
1. Approval of the Minutes of the Meeting held on November 12, 2003
Chairman Sanders asked Code Enforcement Officer Sherrer about the Hector case from
the previous meeting. He inquired if the area had been cleaned up and Mr. Sherrer
answered that it had been done.
Chairman Sanders reported that he had made his proposal to the City Commission
regarding the inspection of rental properties and it received no support and was not
discussed further.
Chairman Sanders asked for a motion to accept the minutes as presented. A motion was
made by Board Member Mann, seconded by Board Member Hurd and unanimously
carried to accept the minutes as presented.
2. Recognition of Visitors and Guests regarding any matters that are not listed
on the agenda.
There were no visitors or guests present at the meeting.
3. New Business:
Chairman Sanders introduced new member, Don Wolfson to the board.
;~'"' All witnesses were sworn in and Code Enforcement Officer Sherrer presented the
following cases:
Case No. 125-04: Mr. Donald K. Nee, 578 Royal Palms Drive, Atlantic Beach, FL,
CHAPTER 4, SEC 4-30 (b) (5) FAILURE TO PAY ANIMAL CONTROL FINE IN
SPECIFIED AMOUNT OF TIME.
Code Enforcement Officer Sherrer recommended Mr. Nee be found guilty for non-
compliance and that the fine of $265.00 should be paid by May 14, 2004 and that a fine
of $50.00 a day be imposed for every day after that. It was also recommended that Mr.
Nee be assessed the full administrative cost of $288.80 and if payment was not made
within 15 days that a lien be placed on the property.
After some discussion Board Member Mann made a motion that Mr. Nee be found guilty
of non-compliance and be given until 6/12/04 to pay a total of $265.00 with no
administrative cost. The motion was seconded by Board Member Russell.
An amended motion was made by Board Member Hurd, seconded by Board Member
Russell, and was unanimously carried to collect a payment of $120.00 by 5/14/04 and the
remaining balance of $145.00 be paid by 6/7/04.
Case No. 154-04: Ms. Latasha Hobbs, 330 Sargo Road, Atlantic Beach, FL
CHAPTER 4, SEC 4-30 (b) (5) FAILURE TO PAY ANIMAL CONTROL FINE IN
SPECIFIED AMOUNT OF TIME.
Code Enforcement Officer Sherrer recommended Ms. Hobbs be found guilty for non-
compliance and that the fine of $210.00 be paid by May 14, 2004 and that a fine of
$50.00 a day be imposed for every day after that. It was also recommended that Ms.
Hobbs be assessed the full administrative cost of $288.80 and if payment was not made
within 15 days that the total amounts due be forwarded to the Finance Department for
collection at an interest rate often (10) percent per annum.
A lengthy discussion ensued concerning extenuating circumstances that have prevented
Ms. Hobbs from making an attempt to pay the fines due. It was determined that her
financial situation was not expected to improve in the near future.
After further discussion a motion was made by Board Member Wynkoop, seconded by
Board Member Russell and was unanimously carried to find Ms. Hobbs guilty of non-
compliance and to suspend half of the fine of $210.00. The total amount of $105.00
should be deferred until 11/14/04 at which time she would begin making payments of
$20.00 per month until the balance is paid in full. Failure to make payment by 11/14/04
or any payment thereafter will result in reinstatement of the administrative cost in the
amount of $288.80.
Case No. 70-04: Mr. Norman Anderson, 55 Robert Street, Atlantic Beach, FL
CHAPTER 4, SEC 4-30 (b) (5) FAILURE TO PAY ANIMAL CONTROL FINE IN
SPECIFIED AMOUNT OF TIME.
Code Enforcement Officer Sherrer recommended Mr. Anderson be found guilty for non-
compliance and that the fine of $110.00 be paid by 5/21/04 and that a fine of $50.00 a
~""'" day be imposed for every day after that. It was also recommended that Mr. Anderson be
assessed the full administrative cost of $288.80 and if payment was not made within 15
days that the total amounts due be forwarded to the Finance Department for collection at

A motion was made by Board Member Mann, seconded by Board Member Hurd, and
was unanimously carried to approve the full recommendation of the Code Enforcement
Officer as presented.
4. Miscellaneous Business:
Code Enforcement Officer Sherrer asked the board members to review his Code
Enforcement Investigation Report for April 2004 and noted that the number of illegal
sign complaints had decreased due to an article that had been published in the Tide Views
Newsletter.
5. Adjournment:
Chairman Sanders asked if there were any more comments. There were no comments
and he declared the meeting adjourned at 8:20 p.m.
